That’s not really a libelous statement.

Who cares. It’s a virus and he is a young healthy athlete. At worst he will run a fever for a couple days. Honestly better to catch it now and recover than during the season

It’s defamatory to accuse someone falsely of having a venereal disease. Not so much To say someone has COVID-19, although it depends on the context of the statement, such as when it reflects on character or reputation. (Like, “X has COVID-19 and deliberately exposed me to it”), It isn’t saying that X had the disease that is defamatory, but rather he acted in a wrongful manner to expose someone else. It could be defamatory if having a disease were a disqualifier for a job or could cause others to shun the person. I dont’ see any of that in this situation.

I think it's unclear what a court would say, although I'm sure these types of claims will be showing up soon.

So, for the plaintiff to win a defamation claim, they need to prove four things:
1. The statement is false (We only have Mac's dad's word on this).
2. The statement was made or communicated to a third party (Check).
3. Basketball fan was negligent in making the statement (this one is especially interesting because if Mac is considered a "public figure" then he would have to show bball fan acted with "actual malice" to defame Mac).
4. The person must be actually damaged from the false statement being made (Tough to tell what damages would be here. Maybe he gets benched and loses a chance to go high in the draft and make millions? I'm sure his attorney would have a creative argument).


I would probably recommend suing for infringing Mac's right of privacy, as I think that's an easier argument to make. Although, that might not be winnable either if the defendant is successful in arguing that Mac is a public figure.

well, last I looked (and it may be different for college athletes, I don't know), if you're Covid positive you have to quarantine 2 weeks, and then get tested negative before returning to "society".

Listing someone as Covid-positive is basically trying to get them thrown off campus.

Anyone who knows Mac would Know that he has never been infected with the China flu.
As far as I know the only infection he has had was a bad case of the bull headed clap. He caught it from that 250# MSU cheerleader a couple of years ago. She was his guide on his official visit. There are 3 Motel 6 within driveing distance of the stadium and she showed him the Presidential Sweet in all 3.

I understand him being concerned for his son, but threatening legal action is, IMO, a bit of a power play. There is no libel case here.

Mac Jones, by virtue of being the starting QB at a major football program, is in the 'public eye' per se. In order to prove libel against someone who is in the public eye, one must demonstrate 'actual malice' -- that is, not just reputational harm (which I'm not sure exists in this case) but also intent to cause harm.

tldr; Mr. Jones is trying to be a good dad, but he's full of shite when it comes to the libel claim.

I know you are an SEC basketball fan so not sure you have missed him at any Bama home game, they show him like 4-5 times a game.

I'm overwhelmed by 2 feelings, can't figure which is more intense:

* Jones the elder is terrible human who deserves no happiness for reacting poorly to humor.

* Only a little bitch implies legal action over something petty like that. I am 100% certain this individual pisses sitting down.

I truly feel embarrassed for the Gumps.
