I think the premise is he drove there while drunk.

Where did you read he drove there drunk? Sounds like a massive assumption to me.

Actually the premise of constructive possession is that he could have taken control of the vehicle at anytime.

It was cold that night. I'm sure he just had it cranked so he could turn on the heater. The lights were on because he had a hard time finding the heater on switch, he left his glasses in the Library .

Holy shite, I posted this tongue-in-cheek but I just heard a Tuscaloosa News reporter on Finebaum. He was praising Hand for his good judgement in not driving when he was so drunk. He tried to claim that he started the car because it was a hot night in Alabama and he wanted the AC on. Then he fell asleep and arrested two hours later. This happened on the Strip but wouldn't say how far he lived from there. Bama Press spin: Player falls asleep in car vs Player passing out behind the wheel of car due to intoxication.

I bashed Gus Malzahn for that and stated multiple times that they should have been suspended. What's your point?

Also, pot < DUI.

The car was parked in a parking lot on the strip.

Yes, he could have driven there drunk, & he could have driven there sober, drank at a nightclub (Rounders is right there), then passed out in the car.

Probably something we will never know.

No it's not. Driving under the influence also deals with drugs.

So the U of A puts the pressure on to get this reduced, just like the with any other student right ?
How is this not an impermissible benefit ? It's got to
be worth at least the cost of the fine.

Massive assumption?

He was in the drivers seat with the car running. Your statement is laughable.

The easiest assumptions are he either drove there drunk and parked it to get off road or he was about to drive drunk.

If he was sleeping it off, why the hell was he in the drivers seat?

I know here if you're wasted and sitting in the car with the keys just in your pocket. You're on the line for DWI.
I'm not sure what the law is in Alabama but if he had the engine on he screwed up. Tickytacky law but it is the law.

Forget the Bama slant and I don't give a damn what the law says (some laws are downright stupid).

Car not moving or running. Car parked. He's asleep. It's a total bullshite charge. No one should be charged for a DUI in that case.

Because that's the seat most people naturally get in to start a car?

Perfect. So now saban can suspended him for the first half of Fresno state. He needs him to play vs FSU.

I've yet to hear a plausible reason why he would do this.

Agreed, and it wasn't a bad arrest by the officer either.

The average joe with a clean record gets to plead this down to public intoxication so Hand should come out fine.
