doesn't say if they were in the ignition.

The car was parked in a parking lot.

and they call it driving under the influence.

per the Alabama Statute
quote:

(a) A person shall not drive or be in actual physical control of any vehicle while:

(1) There is 0.08 percent or more by weight of alcohol in his or her blood;

(2) Under the influence of alcohol;

(3) Under the influence of a controlled substance to a degree which renders him or her incapable of safely driving;

(4) Under the combined influence of alcohol and a controlled substance to a degree which renders him or her incapable of safely driving; ?or

(5) Under the influence of any substance which impairs the mental or physical faculties of such person to a degree which renders him or her incapable of safely driving.

Like I said, he made a mistake but it doesn't make him a bad guy. Article says he was close to campus. probably should have called one of 100 team mates to crash on a couch. But 21 year olds will make 21 year old choices sometimes. Nothing more, nothing less. If I were the cop, I'd have seen if he could get someone to pick him up, but the cops did what they did.

Instead of telling them to do "EXACTLY" what he did, maybe tell them to get in the back seat, or, better still, don't drink and drive.

I think we're talking past each other here.
Or maybe I missed the part where Hand was actually driving?!

I was under the impression that you had to have keys in the ignition. Not just in the car.

well Hand's keys were in the ignition so it's kind of a moot point

Not a big deal. I don't see any reason he should miss game time

Also, a lot of cars now are just push to start when the keys are relatively close.

He very well could have driven to the parking lot. That's likely why that caveat is in the statute of "physical control"

This is one of those cases where Tuscaloosa police forces again fall flat on their face when they have the ability to use common sense discretion when making decisions involving arresting people.

I've never seen a more incompetent collective group of individuals than the ones serving as police officers in Tuscaloosa.

It's also there for when you are passed out at a stop light. Not moving.

Speculate he will play vs FSU.

He could have been driving 120 mph, on the wrong side of the interstate, in a stolen car, with a gun in the seat, and blown a .3 BAL and I still would have speculated he would play against FSU. How is this news?

This is Saban we're talking about. Do players who get arrested in the offseason ever miss playing time at Alabama?

This is the same coach who suspended a star player for a game against La Monroe, then when his team was struggling at halftime, decided to put him into the game anyway.

There was never any doubt that Hand would play in the opener. No doubt at all.

Charges will be dropped and he won't miss one snap. Did anybody think otherwise?

True. I clearly don't know all the details and none of us do as we weren't there.

I just know that if that were me and I got too drunk at a bar and everything was closed I might be forced to sleep in my car. That sure is a better idea, to me, than driving. If that were the case, then I salute Mr. Hand for actually being responsible.

But the flip side of that is, he could have very well been driving and pulled over and then passed out.

Or he could have been parked at the location where he was doing the drinking.

Once when I was young and dumb I got shitfaced and tried to drive home. I quickly realized that I wasn't gonna make it and pulled over in a park and went to sleep. I put the keys in the glovebox and that's what kept me from getting in any trouble. I mean, I clearly had driven my car to where it was, and I was drunker than Cooter Brown. I just played dumb with the cops and those guys actually gave me a ride home.

Oh I don't disagree. It's in there for a multitude of different reasons.
