Maybe we are. The law doesn't require driving, only "actual physical control." Also, unless he was accompanied by companion(s), it may be reasonable to infer that he had driven the car to the location of his arrest.

Yep, I've had friends do both. No telling what happened with Hand so it's kind of dumb to speculate

Before getting hammered maybe. The Strip bar scene is all walking distance. Park, bar hop, eat, return to car.

You may be pissed but you would also be thankful because it might had just saved your life. Many people have died sleeping in a car that was running because they had the heat or A/C on.

Why would that be reasonable? Late at night in Tuscaloosa, you are never more than 5 minutes from home.

It was cold that night. I'm sure he just had it cranked so he could turn on the heater. The lights were on because he had a hard time finding the heater on switch, he left his glasses in the Library .

It is a DUI, but something he may be able to get out of (or reduced to something lesser) with the right lawyer.

Props to the kid for not driving though.
