I could be wrong but I think the last thing anyone involved with this wants a law suit. From the NCAA and SEC offices on down to the coaching fraternity in general. They know what each other is doing....That’s a Boulder no one wants turned over. It’s truly a dirty business and it starts at the High School.

Slander is very specific in court.

I’m no attorney, but don’t think you could sue someone over a secretly recorded private conversation. As slimy as he is, it wasn’t a public conversation, and he certainly had no clue it was being recorded. I thought the standard was that it had to be in a public forum of some sort. He was just trying to prove what a swinging dick he was by making up nonsense. I am confident he has ZERO first hand knowledge of the inner workings of any program ( save UT under Proot).

You can get sued for libel for forwarding an email to 1 individual that you didnt write.

Here is your test for a lawsuit.
1) was the statement (even in private) factual?
2) are there damages?

Intent to be made public is not a factor.
Truth and damages.

Why provide an affidavit? All he had to do way just publicly deny it since he never officially accused anyone. Wow, sometimes people show more guilt when they try to deny a crime. Ask Gov Cuomo.
