The "factual part" is only difficult when "an opinion" is shared. That is how news media outlets get off scott free sometimes (even though they are news shows reporting factual news).

The more strict part is claiming and proving damages. For a lot of nobodies like me, it is usually difficult. But for a brand like UGA (the university is worth over $500,000,000 in physical assets not tied to endowments or foundations), they can probably find a shortage somewhere and lay blame.
