Could be.

Though with cops called and a domestic charge, a fair assumption is that whatever he damaged was the result of a fight with his girlfriend or boyfriend.

He was. DV 3rd has subsections.


If the alleged vic is one of those set forth in the DV statute, they match up the criminal act (criminal mischief/assault/harassing communications) and that is the subsection you are charged with...

because of his relationship to the alleged victim. You will notice he is not charged with assault or battery. The way the law is written you can be charged with 3rd degree domestic violence for pretty much raising your voice.

Thanks for the clarification - - I've got two teenagers living at home, I commit 3rd degree DV every fricking day of my life. I threw a damn biscuit at him just this morning because he can't remember anything. I swear teenage boys lose any brain they have when they hit 15 yrs old.

Dual arrest are pretty common.


Neighbor hears an argument. Calls cops. Cops get there. They don't observe any unlawful contact or unlawful conduct. Phone/door/wall is busted. Cops talks to both parties. Errrrrrrrrrrrybody goes to jail.
