Absolutely hes being or trying to be punished for a wise crack. He is allowed to comment on a matter of Public concern. IE the 5 year eligibilty being unfairly denied to those poor players

Interesting legal question: all SEC members, except for Vanderbilt of course, are state institutions. They themselves are extensions of state government. Since the SEC is just a collection of state institutions, can’t the argument be made that they are subject to the 1st amendment laws which the individual members are beholden to? Otherwise this creates a loophole where any collection of cross state institutions can agree to circumvent the constitution simply by associating together.
ETA: really not trying to troll, it’s an interesting legal argument

The McKenzie guy covered it in his tweet that was the impetus of bumping this thread. He acknowledges that a collection of state institutions have been deemed to be a state actor, but it's not clear if the SEC would clear that hurdle here. It is an interesting question. I have not read the case he cites, so I'm not sure what factors a court would look to in deciding whether the SEC can be considered a state actor here.

The SEC passed a bylaw that directly violated a court order. thats not a "free speech" issue. Your right to free speech doesn't allow you to violate other's, court ordered, right to earn a living.

No one’s “right to earn a living” has been taken away. LSU(or whomever) can still pay them the agreed upon amount.

I'll go on record as saying LSU didn't break league rules- and apparently that fact didn't matter to the home office in this case.
