It is pretty fricking comical that they amended the suit for Lane practicing his free speech rights. Can’t you at least agree on that? It just adds to the whole hypocrisy of all of it.

Violated? I think using “imagine if we had pro players “ comment… a simple off the cuff comment walking away has exploded by people looking to get rid of him because he hurt their feelings.

The original Lawsuit last week from the SEC was a suit against LSU violating the SEC's 1st Amendment Rights. That is what they were originally talking about in the other thread.

The lawsuit by the SEC is based on the 1st Amendment.

No of course not. But joking during a halftime interview isn't even worth talking about. The SEC is picking and choose what behavior bothers them based on who is saying it or doing it. Tenn coach can ask fans to throw shite at Lane. Golding can openly tamper with Clemson's roster. Not a peep from the SEC. Lane talks a little shite...... GET LSU THE F OUT THE SEC.

Anybody with a brain can see how dumb this is. Ole Miss fans is just so giddy they get to feel good about Lane being gone but that won't last.

Yea, the social media stuff got into a very grey area and the question was whether those platforms were public forums, but we’re well beyond the scope of that issue here.

And for the record, I don’t think the SEC’s first amendment claim has a snowball’s chance in hell either. The only state actor that has taken any action to prohibit the SEC’s right to disassociate is the state court judge, and he’s not named as a defendant in the federal suit.

That’s because a government entity is being introduced to force something upon the SEC. I doubt anything will come of it but there’s is a hell more 1st amendment relevance to that

As the SEC is just an association acting through its members (their words), then the actions again Kiffin for his comment to Rowe (including the lawsuit amendment specifically alleging that as the factual basis for a cause of action) would be an abuse of process by a state actor to punish speech.

Not a state actor. Membership is voluntary.

So, no. Not a 1st amendment rights violation.
