i've only been in 1 rear end situation in my life and going to the cops saved my bacon.
i was headed to finals my first semester of freshman year and somebody pulled out in front of me and i slammed on my brakes but still rearended them. they were in a rush to finals, but i wanted to call the cops. they said no, i gave them my insurance info and i went straight to campus police to report the incident, got to my final late with a police note.
a week later they called me instead of the insurance company and they tried to go "it's a rearending and your fault no matter what" route. i said i had a statement with the police about it and they were free to go make one as well. then they dropped it and i never heard from then again.
lesson: document shite.

I have nothing substantial to add to the thread...just wanted to say that Texas drivers are the worst in America.

I got rear ended recently at a yield..And I was destined to stay there until I had the other person's insurance no matter how backed up the traffic got..Got minimal damage so I didn't use it

I've never known the cops to not respond to an accident on a public road here in Alabama. A wreck with over a certain amount of damage ($500 iirc) must by law be reported to ALEA.

Take advantage of cell phone, as you did, but also do a 360 walk-around video, and turn on audio recording immediately so you can record any incriminating statements. Usually anyone who knew they were in the wrong will be the first to say things like, "I'm sorry," "I didn't see you," etc.

His insurance company is going to tell you to go fish. No police report, no accident. His word against yours. Sorry, but you should have called the cops. The guy might be stand-up but you can bet his insurance company is going to tell you to get lost.

about 10 years ago I was involved in a head on, more like a fender on as his front fender collided with mine. Destroyed the front fender , grille, door and other parts on my 1 year old truck. barely put a dent in his piece of shite.
Totally his fault, I was in my lane he crossed the highway right in front of me. Of course he jumped right out "we don't need to call the cops" "oh yes we do" and he attempted to drive off, but luckily by that time bystanders had stopped because my truck was disabled in the middle of the highway and they boxed him in so he couldn't drive off.
Cops show up and this guy has no DL, no insurance, no tags on the truck, fails a field sobriety test and has felony warrants out for him.
moral of the story is , I don't trust anyone

Always get an accident report.
Then you can discuss whether to work it out among the parties.
I got hit from behind. We both called the police. They made an accident report. Damage was minimal and the policeman said we should try to work it out among ourselves.
We got 2 estimates. He paid the bill in full plus enough to rent a car if I wanted.
BUT, get the police to make an accident report just in case.

Got in an accident where both vehicles ended up being totaled. The guy actually tried to convince me to not call the insurance or cops.

Cars today are made with crumple zones and a push in one area can cause a wrinkle in another. I was backed into at work back in January but my damage was to front of truck. Wound up costing $2500 for bumper, headlight, grill and valance piece.
I hit a deer on other side last january and cost over $4000 for similar damage

Wrecks with injuries are mandatory reports also, including injuries in wrecks on private property. Those will go on state forms as well.
