The mom wrote the book and used the conservatorship to sell the movie rights.
If anyone had tied to the family had a say, it was her.
No.
Michael Lewis wrote the book.

Hugh Freeze’s first big off-field challenge at Auburn: staying off of Twitter and out of people’s DMs about this story he is tangentially connected to

The common denominator here is Hugh Freeze.
Auburn -- what kind of scandals do you expect from Freeze?

Went from being homeless to making 34 million in the NFL
I would call that a solid lifestyle change. I don't know what Tennessee could have done for him more then what he did at ole miss

He apparently also wrote about knowing this information in 2011 so tough to say he’s unaware

SOL on fraud
Haven't practiced in this area, but couldn't you argue that since the "conservatorship" was ongoing and begin from the moment it ended? Of course this could all depend on the state.
Not an area I would like to get into. Seems too murky.

The SOL on fraud, which is essentially what he's alleging, starts to toll when the person defrauded knew or should have known of the fraud. That's going to be a tough road to hoe for something that happened almost 20 years ago, which is when this "conservatorship" was entered into. It's more likely that Oher is SOL even if his claim does have merit than the Tuohys being fricked.
Also, as an aside, the Touhys were already rich before that movie ever came to pass. They made all their money in real estate and taco bell franchises, not from the movie
To my knowledge, the statute of limitations resets every time that the Tuohy's get a check. I may be wrong on that.
My "fricked" comment is if this goes to a civil trial with a jury.

I'll have to go pull the book off my bookshelf and see what it says (I trust it more than the movie), but in the movie when Leigh Anne and her friends are having lunch at the country club, one of them says to her
"Well, I say you make it official and just adopt him."
Her response is "He's going to be eighteen in a few months it doesn't make much sense to legally adopt. "
So taken from that, I was never under the assumption that he was adopted. They were just named his legal guardians/caretakers.

Netflix Documentary incoming

quote:Oher admits he signed the conservatorship himself. He is alleging that he didn’t know what he was signing. Which if the Tuoys come back and say “yes he did. He wanted us to handle any business dealings so he could focus on school and football” then he has no case.
It sounds like Oher's attorney has already verified everything.
The thing that’s not on his side is this is starting 20 years after the events and 14 years after the movie came out. I’m not saying this is what it is, but it smells like a cash grab.
ETA: the Tuoys are shady. Don’t get me wrong. But Michael is high if he thinks he has a case when he has admitted multiple times he signed the document and it was explained to him what it was. And now he’s back tracking

Thanks for the correction.
I didn't read the book (obviously).
Is the tone to Oher the same as the movie?
The Tuohy's sold the rights through the conservatorship

This part was interesting to me.
quote:
But Oher's agent, who would receive movie contract and payment notices, is listed as Debra Branan, a close family friend of the Tuohys and the same lawyer who filed the 2004 conservatorship petition, the petition alleges. Branan did not return a call to her law office on Monday.

probably end up settling this and avoid any bad press

The book is much better.

The weird part is there is apparently a document that Oher himself allegedly signed that gave all rights to the movie company.

This is about as tricky as it comes in contracts. A minor entering into a contract with what I'm assuming were his legal guardians. I'm guessing a couple dozen lawyers are going to be the long term winners.

So does the conservatorship. That smells like a cash grab as well. And that is the reason to look at legal options to right a wrong (not perceived wrong... but a wrong).

He was entering his senior year of high school.
And he was handed a paper by a family acting like he was part of their family.
He isn't backtracking. He is shedding light on an occurrence in his youth.
Karma is a bitch. An even bigger one than Leih Anne Tuohy.

Well, having a homeless kid sign documents in his developmental years is probably a bad idea.
Still did the tuohy’s actually make that much money from the movie? I just assumed they made much more from the fame and notoriety afterwards but not exactly much from the movie and ticket sales itself
