Come on, in what world is the inherent fair market value of that oak tree $800,000. There is no way to determine a value for restitution without taking into account external factors around it which makes it impossible to keep a clear line between "restitution to cover losses" and "punitive punishment".

the cost of finding another oak tree that isn't a sapling, removing it and it's root system from one location, transporting it to auburn, replanting it, and keeping it alive during this entire process? yeah, that's pretty expensive. it's not like they went and found an acorn and planted it

Honestly, I think the judge did an assessment of all the real estate that Auburn owns in Harvey's head and determined what a fair rent would be.

$100/month in perpetuity sounds like a good deal for Harvey.

I will give Harvey credit though...

Some of his trolls are pretty funny:

You probably should. He's a poor, old man. You weren't going to get much from him to begin with.

Nope keep turning those screws. If there is one thing harvey can give to the rest of us, it is being made an example of for anyone who thinks this type of thing will be taken lightly.

I think it would have been much more entertaining to make him take classes at Auburn or watch Auburn games at a bar or something funny.

But Auburn people probably didn't want him in town so that would probably be off the table.

Haha, sorry I understand restitution and you don't.

In other words, you're fricking stupid and nobody cares.

Restitution is also generally for objects that have easily identifiable fair market values

someone throws an axe through a 300 year old painting. now put a value on a unique and one of a kind piece of art that has never been sold at auction. i mean you can buy some oil paint, brushes, and a canvas for $150

I have no idea.

And to the moron who compared a hate crime (hanging a noose on a statue) to the tree poisoning . . .

A Clockwork Orange type punishment where his eyes are forced open and he has to watch the Cam-back over and over again. I like it.

We could reduce his monthly rent to Auburn to $10/month I suppose.

We can quibble about the amount but rent to Auburn for life is non-negotiable.

Absolutely! I would want everyone involved in the willfull destruction of my property to pay.
Auburn should add a dollar surcharge to every ticket sold until the debt is paid. You clowns tortured those trees for decades, Harvey did the compassionate thing and put them down.

You can tell the reasonable ones from the psycho ones by posts like this. Updyke will be a useful tool for years.

This would cost around $50,000

Hell Alabama fans would probably even donate for it to happen

What would be funny is if Bama started placing buckets around the tailgate areas, before games, to donate money to pay off Harvey's fine. Once the tailgaters get drunk those buckets would fill up fast.
Glad the Hog fans burned the tigertail van in Arkansas where everyone laughed and no one would prosecute, if it happened in Auburn the tail would have been worth $500,000.00
