Who thinks you have the right to say what does and doesn't affect people? Many fans old and young had made great memories partying after wins under those trees. Those trees were engrained in the school's culture. Then they had some redneck bumfrick from an in-state rival school come in and posion them because he was jealous that Auburn beat them.

To say no one was affected is just the dumbest thing I've read on this thread.

I think it was only punitive in the sense that they considered the actual costs of replacing a landmark. I'm sure they tallied up all they could, but I'm also pretty confident that trying to save poisoned oak trees and then replacing them with mature trees isn't an inexpensive endeavor.

I've never seen an oak tree worth almost $800,000.00. He should have appealed the price gouging judge's ruling. The tree would have to have been made of gold. It wasn't like the trees were making the university money. The actual value of that oak if it were cut for the wood would be roughly $100.00. I could see the judge upping the value to teach him a lesson but it should have been $5,000 not $800,000. he should have poisoned the eagle it would have been cheaper

Well shite, if someone burns your house we'll just estimate restitution based on the value of the scrap remnants, deal?

Harvey obviously has some mental health issues. I think he should have had a longer Jail sentence personally or some type of treatment for his issue, but the restitution amount is laughable

So what about the student from your university that was charged with and convicted of a hate crime and sentenced to federal prison for putting a noose on an otherwise idle statue on campus? I mean it didn't actually affect anyone, it just offended some people. See how ridiculous it sounds when you phrase things so simplistically like "i mean it's only a tree"

Restitution is also generally for objects that have easily identifiable fair market values (ie a house, a car, a plane, money, stocks, etc).

There is no readily available market for old oak trees. They clearly took the highest value for every input available and nobody could really argue with it because it is an ESTIMATE.

Again, whatever, I wouldn't defend the guy, but to argue that this is the normal cost for a big old oak tree to be replaced is silly.
