Say what you will about the trees, but a lot of decent people (families, kids, etc.) enjoyed that tradition and the landmark. An indecent person destroyed it because he's a trashy piece of shite.

I think you can both be embarrassed in general about the tree incident as an Alabama person and think $800K plus jail time is laughably excessive.

I don't really care much, though. There are a lot of unfair, excessive punishments in this world. Guy did something stupid, he lives with the consequences.

Restitution, by its very fricking nature, is not excessive.

Plus, it's not like he's paying it, or could, anyway.

Yeah, the penalties would have been a lot lower if he convinced the judge he was truly repentant.

Perhaps the punishment given out to Updyke will discourage future Gumps from trying to one-up Harvey but I somehow doubt it.

I think it's karma enough that what he has to pay Auburn ($800 K) is about the same amount of paper processed by a Toomer's Corner tree if given in one dollar bills

Honestly it's not like many of us are all burned up over Harvey anyway. We didn't start this thread, and I haven't talked to any Auburn person in a long time about the subject.

It is dumb when people start telling Auburn people they shouldn't be upset about the destruction of a historic landmark, of course.

Come on, in what world is the inherent fair market value of that oak tree $800,000. There is no way to determine a value for restitution without taking into account external factors around it which makes it impossible to keep a clear line between "restitution to cover losses" and "punitive punishment". The dollar amount was punitive, anyone who is looking at it rationally understands that even if they claim otherwise.

I mean, again, I wouldn't go to bat for him either way because what he did was awful and stupid, but $800K? It was meant to make incidents like this happen for the rest of his life. They knew he would have a difficult time paying that off.

I mean, again, he earned it.
