AU has gone after anyone for that issue, but the fear is still their for the merchants.
Not for cupcakes, but they absolutely have enforced many other similar cases
Off the top of my head, I know of a mother who made her infant a navy shirt with a tiger on it. Friends asked her to make some for them. Despite looking nothing like Auburn's tiger/Aubie, Auburn sent a cease and desist letter
There also is a constant monitoring of anything that comes out of Auburn city schools. If any of them use similar fonts or color schemes they'll hear from AU
I want to say it is Jon Waggoner from the general counsel office who handles it when AU's licensing arm identifies issues

It very much favors large organisations and companies
In a weird twist, it also punishes many of these organizations as they regularly have to defend frivolous IP infringement claims. Quite a few companies prefer to settle and pay them off rather than win them at trial due to expenses
I wish they'd significantly reduce the copyright duration + licensing requirements
As you pointed out, the issue is with companies/pepole who sit on copyrights with no intention of using it while others would

You have never been to a trade day in Alabama. Or a city market on a weekend.

Auburn sends out cease and desist all the time and for things as trivial as cupcakes or using and orange and blue tiger on a dress.
I think the thing with the bama cupcake thing was they were making cupcakes for school events and such and still got called out

Doesn't really matter. If either university finds that you are trying to make money off their logo, they are going to try to get you to stop.

Yup, Auburn has a team that even patrols around on game weekends looking for merchandise, I am sure everyone else does as well

I am sure they will try, but both schools do not want it to go to court again. The people of Alabama are getting fed up with both schools handling of their non-athletic operations. Now that Bama has over 50% out of state students and AU with almost 40%, while their children are forced to go to JC due to cost, people are getting tired of the greed coming out of those ivy covered towers.

If they want to go to college. Both AU and UA publish that it cost about $30K per year to attend both schools. How many Alabama families can afford $120K to send their children to college ?
