To end up on death row, you need to be convicted by a jury of a capital crime (unanimously). Typically, the jury also decides the sentence (also unanimously). The judge can always vacate for abuse/irregularities (sentence or conviction). There are plenty of non-state actors.

Mind you, this is an en banc consideration after a 3 judge panel told Boasberg to stick it (2-1).

The Earth's climate has always changed and will continue to do so. The poles have migrated and completely reversed multiple times. Pangea was a real thing.
Without a single internal combustion engine or factory smokestack, this planet was going to eventually become inhospitable to human life. Just as happened with countless other species.
Adapt, or perish.
In the meantime, maybe look for some other places to land.
