Again, the C&D didn't carry the threat of legal action. It carried the threat of disassociation; a threat that was carried out.

Arguing that it is a financial threat to the school is a really tough sell. The school does not have exclusive rights to sell their trademarked merchandise.

Unless it can be proven to be stolen property..

I have zero idea how UA handles player gear, but having game worn stuff by current players is suspect.

If that is true, then how does this guy continue to get sideline access, access to the athletic facilities, locker rooms with players, etc? Seriously, he's posted tons of pics on his facebook that looks like he has pretty up close and personal view to your program.
Just curious, because your average disassociated "person" doesn't typically get to go into the locker room with the players at games.....

If anything plays out at all... I mean shite, bama got away with a coach giving a player money regardless of the statement he "paid" him back. That's still a violation and the NCAA didn't give 2 shits.

The NCAA could suspend players.
The NCAA could go after Alabama if they knew players were selling gear and didn't actively stop it. That's how Ohio State got in trouble.

OSU got in trouble for lying about their violations and then trying to cover it up. Alabama has been upfront about this whole thing, and that's why the NCAA didn't do shite last time and why they won't do anything this time. Signed memorabilia is everywhere, it cannot be reasonably policed.

How in the hell has the NCAA not done anything about this? I mean it is getting to the point where it is laughable. Are there rules anymore?
