The ags have the right to any tradition they choose, but when they know their 12th man "tradition" originated with a radio play in 199 that played fast and loose with the facts, they can't file a trademark application with the federal government under penalty of perjury where they knowingly misrepresent the tradition originated in 1922.
You can't create a false set of facts and then attest to their authenticity in a federal trademark filing and again in a federal court pleading. What would happen to any ordinary individual if they knowingly filed a fraudulent pleading in federal court?
The bottom line is that Texas A&M University has been lying about their 12th Man "tradition."
It shouldn't take long for the Texas Attorney General to give his opinion on all this.
At the very least, the university shouldn't be lying to the public about the 12th man tradition. they should have the dignity and integrity to be honest.. Sadly, they don't.
As has often been said, When it comes to Texas A&M, those who know them least respect them most.

Nobody reads Texas Monthly anymore. Few people will see that article, even less will care, the high up Ags and Longhorns who run this state will laugh their asses off if it's ever brought up to them and nothing will come of this.

So Gill played all three sports at A&M (football, basketball, and baseball). He left the football team earlier in the season of his famous 12th man event in which he was not really the 12th man. Because A&M had over 20 reserves standing on the sideline when Gill came to stand on the sidelines too.
So after reading this I can say the 12th man saying is not based on a significant event but rather it is just a popular catch phrase that needs to be protected by lawyers.

Like, I am not aware of even one case where the TTAB or the Federal Circuit invalidated a trademark for an incorrect first use date.
"Fraud" in the context of trademark prosecution is a specific term with very specific (and very high) standards that Randy seems to be utterly unaware of.

At the very least, when Verne Lundquist talks about the great TAMU 12th Man tradition and the hero that E. King Gill was, understand it is a fairy tale that has been highly embellished by the university to misrepresent the true story. Gill was no hero whatsoever until the fictionalized 1939 radio play and when the TAMU administrators have been representing otherwise, they have known they are being intentionally dishonest.
You will find most of the great "traditions" of TAMU don't come close to the reality of what actually happened. Fabricating their school's history is one of TAMU's most cherished terditions.
