Should be that way. Pay for play comes with contracts that both sides uphold.

So you want a contract employee but a one sided contract where you only have to pay under certain conditions but he always has to work

I don't agree with taking away money because they played poorly, or didn't record enough yards/tackles. However, if you miss games because of academics, failing drug tests, suspended for disciplinary reasons, missing meetings/workouts, quitting the team, etc. then the team shouldn't be obligated to pay the full amount.
I would like to see at least 2-year contracts however so we don't have this annual NIL transfer portal free-for-all. That being said, players that sign mulit-year contracts will likely try to do hold-outs and such if they go crazy in the first year of their deal, trying to renegotiate.

Seems like a lot of stuff has to happen before that can work. You can't really force anyone to play a game and I really doubt the NCAA has a legal leg to stand on in order to force NIL contracts to have language in them where a player only gets paid if they play all games. Probably needs 1) Conferences to break off 2) Classify the players as employees 3) Create a CBA 4) CBA says the employees can only sign with NILs that have language in them compelling them to play all the games or you will be penalized 5) And now that you are an employee, you can be restricted from transferring to a new employer - those court rulings on transfers are about students, not employees

That’s not how NIL works and the NCAA/universities will have to revise their policies on pay-for-play with student athletes. Essentially they would become employees of the universities.
Outside of that, bowl games, scholarships, the NCAA - none of it can regulate NIL or compensation from NIL for on-field performance.

Then that’s not collective bargaining. You can’t organize then say I’m not going to negotiate….. who are they going to negotiate with?

My bold prediction is that there's going to be one too many injuries in playoff games to projected first round picks and at some point there will become sorme organized pushback from the players.
The thing that many tend to forget is that 95 percent of these first round draft picks didn't grow up dreaming of playing for the flagship university in their state – they grew up playing in the NFL.
And when the're so close they can sniff it, after putting in years and years of work, then they have to go out and potentially play 3 more games when they could be training for the NFL Combine and get a nice chunk of money fronted by their agent and cash in.

Define performance clause. So a guy has a bad game and you dock his pay? Yeah good luck with any player on planet earth signing that bud. You want to say a player has to show up to play, attend meetings, and go to practice, sure.
