Didnt I read that Miles was over a street or two, getting his girl friend out of a fight. The prosecution is saying he was away from the scene because he was protecting his GF from being shot, because he knew there was going to be a gun fight. When did the Tuscaloosa police come up with this story? the night of the shooting or did they make it up later? Also, the other girl in the car told the police that Miles was trying to calm the situation down. And I think somewhere in all this he had gone to get food and was carrying that around with him. Just doesnt look like someone that was expecting a murder to take place.

Yes, the case against Miles looks very weak based on what we know right now.

I have to assume the prosecution has more on him.

I could be 1000% wrong but I think the initial shots from both weapons came from inside the vehicle

Here's what happened in latest hearing in Darius Miles capital murder case

Judge Daniel F. Pruet denied one motion from the defense and granted two from the state of Alabama during a hearing in the latest Darius Miles capital murder hearing Friday in Tuscaloosa County circuit court.

The state had filed a motion for discovery/production and a motion for more definite statement. Meanwhile, the defense for Miles had filed a motion to amend a May 24 order.

It's the latest step in a long process that began on Jan. 15 when Miles, who's a former Alabama basketball player, and Michael Davis were arrested and charged with capital murder after the fatal shooting of Jamea Harris near the Strip.

Investigators said the gun used to kill Harris belonged to Miles, 21, but that Michael Davis, now 21, pulled the trigger, per court documents. A grand jury indicted Miles and Davis on capital murder charges in March. Both have been jailed without bond since Jan. 15.

Two bond hearings have been held for Miles. Throughout, his attorney, Mary Turner, has argued Cedric Johnson, the boyfriend of Harris, was the initiator of the incident and that Miles provided the gun to Davis for protection. Davis’ attorney, John Robbins, has argued Davis acted in self-defense. Meanwhile, the state’s position is that Davis shot first.

Michael Davis denied youthful offender status in shooting death of Jamea Harris

Michael Davis, who was arrested on a capital murder charge along with former Alabama basketball player Darius Miles in the January shooting death of Jamea Harris, was denied youthful offender status at a closed court hearing Friday morning, his attorney confirmed to The Tuscaloosa News.

Davis was 20 years old at the time of the shooting, in which Harris, 23, was killed by gunfire near The Strip on Jan. 15. Had youthful offender status been granted, it would have potentially limited prison time for Davis and, among other provisions, allowed him to be tried by a judge rather than a jury. Instead, he will face trial as an adult.

Davis was also denied bond in the hearing, was formally arraigned, and pled not guilty, according to his attorney, John Robbins. At a hearing last week, motions related to discovery and pre-trial immunity were heard in Miles' case.

Both Davis and Miles have been jailed without bond since the shooting. Per court documents, police investigators believe Davis, now 21, shot Harris as she sat in a vehicle on Grace Street, adjacent to The Strip near the University of Alabama campus, and that the firearm belonged to and was provided by Miles. The two were indicted by a grand jury in March. Miles also has entered a not-guilty plea.

Robbins has argued self-defense on behalf of Davis, while Miles' attorney, Mary Turner of Turner Law Group, has said Miles made the firearm available to Davis for protection.

According to police reports, the shooting stemmed from an argument between Davis, Harris and her boyfriend, Cedric Johnson, who was issued a subpoena in May.

You'd think that ol Cedric once again evading service, this time having his mother conceal his whereabouts, would tip the cops and prosecution off that they may have arrested the wrong people.

I think the Tuscaloosa police filed charges way to soon in this case. Whether they end up being right or wrong, they reacted and charged two people before they did a thorough investigation. Most of these other police departments will take their time before they rush to file charges. There are a couple of things revealed in this hearing that showed they didnt have the facts or investigate until well after the charges were filed. Hope they are not just in cover your arse mode. Also, on the question of who shot first, does anyone really know? Can that be confirmed from the evidence?

The judge sounds like he is very much in cover the DA's arse mode. He seems to be trying to prevent video evidence that incriminates the gangsters.

Unbelievable that the defense attorney got one of the people involved to admit being in a gang with the guy they can't seem to get to show up in court.

The more that comes out about this case, the fishier this whole thing looks. It seems no legit investigation was done at all.

The prosecutors were even objecting to video evidence from the bar across the street. WHY DIDN'T THE PROSECUTION ALREADY HAVE THAT? Why would the Defense need to get that obvious evidence for them? How can they possibly say a full investigation was done if they didn't even seek out all of the available video surveillance?

Arrest when you have enough for a warrant and finish investigating later is how a ton of police departments handle murder cases. The problem they have run into here is that pretty much their entire theory of the case is based on a single statement from a guy who is sketchy as frick (that's putting it lightly) and has now proven totally uncooperative. Given the nature of the case and the parties involved, dropping it without irrefutable proof that Johnson was the aggressor would be a massive political risk for the DA. There'd obviously be a wave of negative stories revolving around accusations of special treatment for a former Alabama athlete, the victim's family would bring in the usual suspects like Ben Crump or Lee Merritt, and the whole thing would become a circus.

They know by now that even if they survive the immunity hearing they face a major uphill battle at trial. Like, even if Johnson is located and dragged in to testify his status as a gang member shreds his credibility. Especially in light of the fact that his vehicle's behavior prior to the shooting is like drive by 101.

If he isn't forced to testify, I don't know how Miles could possibly get a fair trial here.

Hell I don’t know how they even get it on Miles’ dumbass friend. Backseat girl has all but said she was blackout during the whole thing. Johnson’s testimony was vital in the arrests

True enough. There's reasonable doubt all over this thing. They can't definitively say who fired the first shot.
