Student judicial affairs will 100% be a tougher battle than in the courts. It usually is with stuff like this. there really is no due process and they kind of do what they want.

Throwing an empty water bottle, can, trash, etc. would not cause a reasonable person to fear imminent bodily injury. That's why I said most of these charges will not stick if they try to go for assault. The people who did throw full water bottles, beer cans, a golf ball ( ) could be prosecuted for assault; however, the problem will be proving who threw empty bottles and who threw full bottles (and who threw the golf ball). It's really just a bunch of shite cases for an ADA with the burden of proving something "beyond a reasonable doubt." Intent is also a a big part of that particular element. I don't believe any fan was intentionally trying to make the Ole Miss sideline fear for their personal safety. That is appropriate for something like throwing punches at someone and not connecting, not throwing trash onto a football field. That's why I've been saying disorderly conduct is the more appropriate charge for the vast majority of these people

(1) Engages in fighting or in violent or threatening behavior;

(2) Refuses to obey an official order to disperse issued to maintain public safety in dangerous proximity to a fire, hazard or other emergency; or

(3) Creates a hazardous or physically offensive condition by any act that serves no legitimate purpose.


The state could absolutely carry their burden on disorderly conduct. Their biggest problem, however, will be whether they are actually able to positively identify most of the people who were throwing stuff on the field. It will not be easy.

But what about the mustards that got chucked? I can say without a doubt I was paralyzed with fear when I saw that bottle of French's flying through the air.

Around 2010 UT got cameras etc from Homeland security, and since have been updated. Recently the gov made available millions in grant money just for public education to get state of the art security enhancements like AI etc.

The USSR had more legit courts than university student trials.

While frick UTK, I am sorry to hear it is like that there as well.

Gotcha.

I feel like the prosecution could paint the picture of 102k angry, drunk fans pelting the people on the field with objects would place most reasonable people in fear of imminent harm or bodily injury. It would be interesting to see that. Maybe a tort claim and not a criminal claim, though, because like you said, proving intent would be difficult.
