Dude, you really need to read about "what situation he put himself in."

You are part of the problem with social media and society today.

Schiano was mentioned as possibly witnessing child rape based on Mcqueery hearing from someone else, that a different someone else told the first someone else Schiano looked white as a ghost one day.

Thats right mcqueery heard from person A, that person A heard from person B, that shicano was pale one day leaving his office......

He was on Sandusky's staff for 5 years in Happy Valley and the first charged occurrences of child sex abuse happened during that period, it does create the reasonable inference that maybe something along the lines of what McQueary testified to in the deposition occurred. Now because I love this country and what our legal system represents, I'll give Schiano the benefit of the doubt and he has denied that testimony but to completely separate him from Sandusky and the whole tragedy as if he was unequivocally removed from all that when so many others were culpable during that time period is just flat-out ignorant and naive.

Currie hadn't tried to play secret agent with the coaching search and listened to literally ANYONE in the Athletic department who told him Schiano would not go over well, none of this would have happened.

Something was going to be wrong with every one of his picks. It’s better that you all fired him and I hope he gets every dollar the University owes him.

If I were Schiano I would hire at least a dozen lawyers and file suits against the university, the athletic dept, the boosters, and every UT fan that posted lies on every message board accusing of him being a pedophile and/or supporting pedophilia. Drag everyone into courts all over the country and tell the lawyers they can have 90% of any damages awarded.
Tennessee fans should be ashamed what they did to the reputation of a man simply because they wanted a guy that didn't even give a shite about their school or their job.

Preception is all that matters in today's world.

Just like teachers with these kids. Why even give out your fricking number? Im by far a perfect person and I was a military recruiter. Hours of ethics training because of others. I never got in a govt vehicle alone with a female applicant. I never had my office door closed, and I'd usually have the Army recruiter come over just so I had my back covered.

Just me. I don't want ANYTHING to ever affect my name or my family.

Hope ppl understand this because this world will frick you for one wrong thing. And I know CSB but it applies.

This.

fricking dumbasses saying Schiano was in the wrong place at the wrong time as if there's any evidence of that.

Implied authority.

Tenn. will use these arguments to negotiate a reasonable payment to Schiano. But they'll pay him something.

You’re looking for “apparent authority” which does exist as a legal theory. But if the MOU requires the extra signatures and it’s not signed by all necessary parties then no it is not enforceable.

I dunno, it’s possible they’d pay him a pittance to shut him up, but based on what’s been reported he’s not entitled to anything.

According to a report from Jimmy Hyams of WNML reports that the memorandum of understanding between Greg Schiano and Tennessee is invalid due to the fact that it was not signed by the school’s chief finical officer or the school’s president. Per Hyams it was only signed by Schiano and then athletic director John Currie. Currie is not on the list of officials who can approve a hire at Tennessee.

This statement alone doesn't get Tennessee off the hook.

If Currie presents himself as a decision-maker authorized to move it forward, then a claim can still be made against the university. The university may be liable for promises made by its employees and representatives which caused damages. (I don't know if Currie made that representation or not, but the language on the agreement would go a long way in determining any mis-information on he part of a Tennessee representative)

I'll admit you kinda tipped your hand when you started using the legalese, expertly done.

FWIW: I'm a year and a half from becoming one as well

I think he left PSU several years before the first mention of Sandusky being a pedophile occurred in 1998.
But don't let facts get in the way of your rants.

Bass, you're my Ninja, you know this, but surely you know what "WITH CAUSE" means.

He may get some sort of severance, but nowhere near his buyout.

You're right. I'm the problem. GTFO bro. I'm posting on an anonymous message board where I've been told by fellow posters that this happened, some with credible sources that make him look guilty, but I'm the problem.

He should be fighting this shite with PSU and Tennessee if he's innocent.

F off dude. Say I'm the problem.

Yeah, he's right. You are part of the fricking problem. Maybe he is going to fight Tennessee. But you're the one right here, right now, stating as fact that Schiano was there, even though there has been zero evidence and zero eye witness testimony that he was.

You've "been told by fellow posters that this happened, some with credible sources that make him look guilty," Are you really that fricking stupid? "Fellow posters" have "credible sources" about Schiavo? Jesus fricking Christ.

Exactly who knows. I actually thought the hire was good until Tennessee fans and other fan basses spammed the rant saying he was a pedo.

All i was saying that it doesn't matter. Preception can ruin your life and career.

Not exclusively, no. But to be perfectly frank, without seeing the MOU itself, this is mostly speculation.

The Barnes MOU did have that language in there.

Whenever you’re dealing with a contract, the four corners of the contract will control unless a term in the contract is void for whatever reason such as going against public policy i.e. illegal activities, etc.

If the MOU requires the extra signatures and those signatures aren’t there, then it’s not enforceable.

As an aside, oral contracts do exist, but the Statute of Frauds requires a written contract when employment lasts for longer than a year.
