Tennessee may have dodge a bullet by hiring Jeremy Pruitt instead of Greg Schiano to be the school’s next coach. And now it appears that Schiano may not be getting anything from Tennessee.

quote:

According to a report from Jimmy Hyams of WNML reports that the memorandum of understanding between Greg Schiano and Tennessee is invalid due to the fact that it was not signed by the school’s chief finical officer or the school’s president. Per Hyams it was only signed by Schiano and then athletic director John Currie. Currie is not on the list of officials who can approve a hire at Tennessee.

I think it will come down to intent. Currie was recognized as the official representative of the University. How was Schiano's party to know who is on that list of approving authority.

There's signature lines on the MOU for an approval authority that were not signed? Or do you think an MOU with millions of dollars at stake wouldn't be reviewed by his agent/attorney?

The MOU is described as a “binding and legally enforceable agreement” once fully executed (signed).

Significance: Note first that the MOU must be signed by all relevant parties in order to become binding. In the case of Barnes’s MOU, four persons had to sign it: Barnes; vice chancellor and athletic director Dave Hart; chancellor Jimmy Cheek; and treasurer and CFO Butch Peccolo. If Schiano’s MOU contained similar requirements, it would not be enforceable unless signed by all of the listed persons.

From the SI article.

Schiano is shite out of luck.

Oh well sucks to suck.

He didn’t deserve shite from UT. Moron Clay Travis should be the target of his civil suit now.

Many contracts have been forced to be paid or partially paid without signature. I have no clue what will happen here and won't project, but I am interested in seeing how this plays out.

Hope he tries, honestly. Don't think he'll get anything out of it tho, but it would be incredibly entertaining

Good for Tennessee.

For Schiano, I think it's bullshite and his name is ruined because of Tennessee. BUT, that's his own problem for EVER being involved in his mess.

Tenn will settle this out of court and pay him an agreed upon amount

It would be a retarded decision for them to take this to court

Well, it is Tenn so I change my stance. They will make the most retarded decision

No one give a frick

But in reality that is now how the law works if Schiano did not know Currie had authority.

Please tell me what he was involoved in with proof.

For example, I said I saw momentoftruth witnessing child rape.

Currently, there is more proof you witnessed child rape than schiano.

It most certainly would be retarded to take this to trial.

Why not simply move to dismiss for failure to state a claim upon which relief can be granted?
