UT is going to have to pay their way out of this one. Schiano might never coach again because of UT, and it's going to cost them.

For all we know Schiano could've sent his letter of resignation to Urban as soon as he signed the MOU. If he had did this that's detrimental reliance based on him having the Tennessee job.

Memorandum of Understanding(MOU) apparently signed by Schiano and UT. It will be argued whether this will be enforceable. “Parties often draft agreements with language that blurs the lines between a contract and an MOU. The key
is to focus on whether the parties intend to be legally bound by the terms of the agreement. Although what the parties call the written document may provide evidence of their intent, it does not determine the type of agreement the parties have created.”

Basically, Schiano hires good lawyers to he intended to be bound by the terms of the agreement and UT will have to pay. They might get away with not paying full buyout but they will pay. Schiano will probably remain the DC at OSU and get a “raise” for a day of BS.

Leave it to UT to make a terrible PR move and pay a guy that will never be a Head Coach again.

If it was a multi year deal it’d have to be in writing, statute of frauds.

You guys are missing the point. You don't actually hold the press conference - just threaten it. You think Schiano wants to be involved in a defamation lawsuit for the next 3-5 years over the University of Tennessee's statements about his alleged complicity with child fricking?

Trust me, if UT in any way does this or attempts to do it and perpetuates the perception that Sciano enabled these horrible acts, they are going to be sued into oblivion.

I'm a lawyer too and I haven't seen anything that says they had a signed, written agreement. As a lawyer, you should know that a "mutual understanding" isn't an enforceable contract.

How? The ex Penn State QB is the party that made the allegations. I haven't seen anyone from Tennessee make a statement that Schiano turned a blind eye to Sandusky diddling little boys.

If perpetuating incorrect perceptions gave the victim a legal cause of action we'd all be in lawsuits all the time.
