A federal judge dismissed a lawsuit against the NCAA on Monday after concluding that the NCAA is not a recipient of federal financial assistance and therefore not subject to Title IX.
Biggest news in College sports right now
In a ruling handed down on Monday, United States District Judge Tiffany R. Johnson concluded that the NCAA is not subject to Title IX regulations because it does not qualify as a recipient of federal financial assistance.
U.S. District Judge Tiffany R. Johnson said in her ruling, obtained by USA TODAY Sports, that the issue of the lawsuit's issues with Georgia and Georgia Tech was a moot point.
Johnson cited NCAA v. Tarkanian (1988) in dismissing the constitutional claims against the NCAA, stating the NCAA is a nonprofit organization and most public universities are under state control

So silly imo
Everyone that is part of the NCAA is profiting, including the players now … but it’s a “non-profit organization” lol. Make it make sense.

This is bigger than the Protect College Sports Act, as Title IX is the original protect college sports act, and a judge has just ruled that NCAA is not subject to that law.
Following the logic of recent events, if the new law passes and is signed, judges will immediately start issuing rulings and TROs to make it ineffective

A female judge just ruled against Title IX.
I'm not really sure what to think at this point.

They don't either and they're the ones making decisions. That's the problem.

Not the same thing. Title IX is aimed at any school or institution that receives federal funding. The PCSA is aimed specifically at the NCAA. But, still, your point that federal judges will simply TRO it into irrelevance is completely valid.

Its member institutions do receive federal financial assistance.
It's hard to see how this matters or is the biggest news in college sports right now. I looked for it on several news and sports sites and no mention at all.

Title IX was the single biggest impact law has ever made in college sports. A judge has just ruled NCAA is not subject to Title IX.
This has the potential to impact the single biggest change in college sports law.
The NCAA has announced that they plan to abide by title IX, however, this ruling will, if it stands, allow the NCAA to pick and choose what they abide by.

Help me understand this. My understanding is this is they universities have many of the women's sports to begin with, does this mean we are going to see universities starting to remove women sports?

What? Do you think employees at non-profits work for free?

I don't think so. The universities themselves are obviously subject to Title IX.

If this ruling stands, the NCAA will selectively adhear to Title IX, using it to justify rules, however, students would have no legal means to force NCAA to adhear to the law.
NCAA would get to make whatever interpretation of Title IX suits their current agenda and athletes have no law to redress their concerns when NCAA ignores parts of the law or twists the law as in the case of transgender men playing in women's sports

Bcause the NCAA , does not recieve federal funds. The schools that take federal money are still subject to Title IX

According to the ruling, the state universities are government entities and not subject to Title IX

None of this matters, though, because those students don't go to NCAA Non-Profit University.
If a school violates Title IX, the students can absolutely sue them.

According to this judge, the individual schools would be subject to the NCAA in sports.

Do you really think that people working for non-profits don't get paid?

Title IX applies to schools and not NCAA, this is not going to change anything.
It is not a sports specific item and any school getting federal funds will adhere to it.

NCAA is not subject to that law.
But all of the Universities receiving public funding are subject to it, so unless I am missing something, it doesn't really do anything except limit NCAA liability.
The Universities composing member institutions of the NCAA will still have to abide by it, no?
