IMO, if he blew and was over .14, he should be suspended or kicked off the team. If he was over .16, no doubt about it. Approximately 85% of DUI fatalities are people with a BAC over .16 (or .18 I forget which it is). If he was under .10, he probably should not have even been arrested.

That is another discussion though.

Completely agree. Good post.

Mine was for a .085.

I knew I was drunk when I left the bar. I went to a buddy's house to sleep it off. I woke about 4:30am and walked back to my car. Cops had the block around the bar bracketed. Pulled me over about a mile and a half down the road as I drove through campus.

They said I ran a red light -- not really possible at 4am. They took a mile and a half to pull me over for running that red light.

I considered myself sober when pulled over, especially after the 3 hour nap. Didn't stop them from arresting me.

Everyone seems to think a DUI means the guy was causing havoc, knocking over mailboxes, puking out the window and fricking white womens. When most of the time, it's just a little bit over an arbitrary limit.

I've told my story here before. Blew a .078 and .081 after passing the field sobriety tests (which are designed for you to fail). Still got arrested, ticket and all the rest. Cost me about $8k in total by the time it was all said and done and trial was over (not convicted of course).

DUI laws are a clusterfrick and are designed to be a money maker first and everything else a distant second.

So whenever I see DUI, I withhold judgement until a BAC is released or a refusal is noted.

Personally, I think penalties should be very very tough on anyone who refuses to blow (like 10 days in jail along with loss of liscense as a starter). Make people blow. Then if you are under .10, have a nice day, no citation, maybe call a cab and leave the car. Then a sliding scale of penalties depending on what the BAC is. Especially considering 85% of the serious accidents occur when people are more than double the "legal limit ".

Make the laws fit the reality of whether the person is really endangering others.

Anyway, that is my take.

If you refuse to blow or give blood then they charge you with implied consent and you lose your license. And in most states, you'll get nailed with that PLUS a DUI because DUI does not require solid evidence (one of the reasons why the laws are so messed up) all it requires is for a cop observing you to claim you failed sobriety test and guess what? Those field sobriety tests are designed for you to fail whether you've had a drink or never had a drink before in your life.

The standard rule of thumb is that an officer has determined whether you are DUI/DWI or not before he ever pulls you over. THAT is how bad the laws are.

DUI/DWI laws are an area of criminal law that treats cases like traffic court in terms of your rights (meaning you basically have none) yet punishes you as a real criminal. That legal no man's land should never exist considering the consequences.

DUI= potentially deadly outcome. I do not subscribe to the I'm a 20 year old or college kids are gonna do this. No, they are representatives of the University. If we are gonna call them regular college students then take away the free tuition, books, housing and all the perks that go along with playing college football and make them pay their way and struggle like the rest of us did like "normal" college students do. You get all this and part of your committment back to the school is to keep yourself out of trouble. You ARE NOT an ordinary student and you have to hold yourself to higher standards.

I hope he is back at his home tonight. He was a starter and I say this. Until there is a zero tolerance policy these idiots will continue to be the players that are a part our university's representation. Letting him back in any way just says "son you get second chances in this world all the time" and unfortunately, we dont always get second chances and would teach him a bigger life lesson than letting him play. Any of these self-induced screw ups need to purged. All schools.

Whatever dude, he made a mistake. Punishment is in order, but he is by all accounts a good kid, he just made a dumb decision. You said that letting him back doesnt teach him a lesson, but I think that you are wrong.

He has 14 rings, he does not have to answer to anyone. I blame that TPOS Pat Dye for this.

OF course the irony in all this is that his mother during his recruitment kept harping on the lack of player control by Richt as to why she wanted Bama. Are they still in lead/did they win the Fulmer Cup yet?

It would have taken Saban dragging Geno out of his car before he started it to get him out if the DUI. This has nothing to do with control of a program. Kids do stupid things. Maybe Geno's mom is ignorant to that fact.

Dumb decision but there is no reason to be kicked off the team.

I agree with this. Since it's his first offense, he should be sat for several games, chewed out by Saban and the team, made to run stadium steps, and he needs to do community service work.

You're kidding, right?

Vandy had four players each charged with multiple sexual assault counts and other related charges.

Short of someone going on a murder spree, they're going to win it and set an all time high points total.

I am going to take a different road here, I think he is punished severely but not because of the DUI itself (although the poor decision making there adds to it and legitimizes it, especially as a minor). I think he will be punished severely because he is out drinking two weeks before the fricking season opener, if he had done the same thing in April it wouldn't be as big of a deal to Saban. I doubt he is kicked off the team, but everyone will learn the lesson by example that a team player doesn't drink from August 1 through Jan 7.

They were on a two-day break if I'm not mistaken.

And the idea of players not drinking for the entire season is ludicrous.
