How does this play out?

Everyone knew this was coming.....
either they Tie it to profit by program, which would mean only Football and Mens basketball would get money, then according to Title IX it would need to go proportional to mens and womens sports......
EDIT: i just read that the current lawsuit by 8 Female athletes only effects the retroactive NIL money...not the current revenue sharing settlement...i'm sure that will come later

Remove all scholarships from football. Pay them straight. Then you don't need title 9

Pretty much. If football is purely a revenue sport, why even bother making them students?

Going through the motions until they just make them straight up employees. The schools are trying to show they tried to make it work.

Seems like if you agree to be part of a class action lawsuit you should have to accept the results. Now somebody like Livvy who chose to stay out could come back with Title IX claims but her’s will be more about her belief she’d have received more money individually than the settlement provides and she’s likely right.

The text of Title IX is "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance"
All the schools have to do is show that it isn't based on sex but based the revenue that each sport produces. Considering that there's few, if any, women's sports that are profitable, even in the pro leagues, it should be an easy suit to defend against. But, as I said, it depends on the judge.

By the way... why does this even apply to football? SEC football programs are an activity that doesn't receive federal funding. The schools do but the athletic programs do not.

So, they want equity but want the same treatment as the men who bring in all the money? Doesn't sound very equitable to me.

I agree, but how does that address paying male athletes in non-revenue sports, which most are?
For example, if a school's baseball program and softball program both lose money, how do they justify paying the baseball players twice as much as the softball players? It makes for an interesting debate.

On the retroactive NIL, they could have a valid complaint. If the money is being paid out of the NCAA's pocket as opposed to the revenue driven fund of the future, then that would be subject to title IX considerations as that money would be federally funded.
