Ten players from North Carolina State’s 1983 national champion basketball team have sued the NCAA and the Collegiate Licensing Company seeking compensation for unauthorized use of their name, image and likeness.
The players filed suit in Wake County Superior Court on Monday, requesting a jury trial and “reasonable compensation.”
The late Jim Valvano’s 1983 team became known as the “Cardiac Pack” for a series of close victories culminating in a 54-52 win over Houston on Lorenzo Charles’ dunk in the final seconds. Valvano’s run around the court became an iconic moment frequently replayed as part of NCAA Tournament promotions.
“For more than 40 years, the NCAA and its co-conspirators have systematically and intentionally misappropriated the Cardiac Pack’s publicity rights — including their names, images, and likenesses — associated with that game and that play, reaping scores of millions of dollars from the Cardiac Pack’s legendary victory,” the lawsuit said.
NCAA spokesperson Michelle Hosick did not immediately return a text message seeking comment Monday from The Associated Press.
Plaintiffs include former team members Thurl Bailey, Alvin Battle, Walt Densmore, Tommy DiNardo, Terry Gannon, George McClain, Cozell McQueen, Walter Proctor, Harold Thompson and Mike Warren.

If they can prove who made money off of their moniker and how much, they've probably got a case. I know I'd hate it if others made a ton of money off of my likeness WHILE I'M STILL ALIVE and I didn't see a penny of it.

I'm not an attorney and simply don't understand the law in this area.
Everyone involved in college athletics has made money from the NIL of amateur athletes prior to the SCOTUS ruling. If every former athlete sues the NCAA and their respective institutions, there simply won't be enough beans in the pile to go around.
How many MSU Dak Prescott jerseys have been sold in the state of MS?
How much does Arkansas owe Corliss Williamson? UGA to Herschel Walker? Alabama to Forest Gump? I have no idea where it all ends.

The elephant in the room is mostly the NCAA taking advantage. Now only recently (last 10-15 yrs) have profits seemed like they've skyrocketed so not sure what case they have. If the NCAA can prove that their education and amenities were worth comparably to what an income could've been I bet this gets shelved.

I'm not sure I follow. Are they alleging showing highlights of their famous play was an infringement on their NIL rights?
They can't be serious with this. The NCAA has a lot on it's plate, and rightfully so, but that's a big stretch.

Phi Slamma Jamma, Hoya Paranoia, Fab 5, Doctors of Dunk, Duo of Doom (Elden Campbell and Dale Davis at Clemson for those who don't know), etc. I can see a lot of lawsuits incoming. I hope they run the NCAA out of business.

Oh good god guys. It's been 41 fgn years. These reporation suits are stupid. I guess we need to pay the 76 UGA defensive players for all the Junkyard Dawg t-shirts and car tags? The Fab 5, Phi Slamma Jamma and offensive players in the "fun n gun" at Florida will have claims. Enjoy being the cardiac pack and what you accomplished. I don't agree with Reggie Bush being given back his heisman or anything else that happened prior to NIL being a formal document. If you got a nickname, award, national title, etc before pay for play was legal and you broke the rules that were in place at that time then you are fricked as far as I am concerned.

My current theory is that this case is a trial balloon. If it even remotely has legs, they will go for class action status.
Then it will be just like the Tobacco settlement. The lawyers will all get rich AF and each of the athletes will get roughly $137.

The NCAA has done a shitty job but they simply can't keep up with the lawsuits that are never ending. The entity that takes over won't do much better.
