In Alabama, first-degree possession of marijuana is a felony charge defined as possessing marijuana for reasons other than personal use, or a subsequent possession conviction. It is typically a Class C felony, punishable by 1 year and 1 day to 10 years in prison and up to $15,000 in fines.

They didn’t have a warrant for recreational use marijuana, he either sold to an undercover or someone flipped on him.

This is going to really be the issue and I guess what they define as personal use.
I’d read amounts over 2.2 pounds is intent to distribute but that could be wrong. I’m not really justifying what he did at all, but I could definitely see someone who has over a million dollars and is a regular smoker just buying a pound for personal use.
A dealer in a college town would run through a pound VERY quickly. Just doesn’t make sense.

If the West Alabama Narcotics Task Force operates like every other regional drug task force then this is 100% what happened. It's how they operate. Flip someone in jail, get them to make a buy, get a warrant.
