not a laywer, but pretty sure abandoned property is fair game. kinda like if you get told by your spouse that you need to move out and do it, you lose a whole lotta rights and leverage re: the house/property. now if he tried to go get them, she didn't allow it and she just claimed as her own, that's completely different.
