Do you think that attending a public university is a privilege or a right? If it is a right, then you basically believe that it should be open enrollment and treated like K-12 education. If you view it as a privilege, which the Supreme Court and every other FEderal district court has determined it to be, then the standards of behavior are higher for its students. They can demand that students meet their expectations to attend.
That’s why students can be removed from the University setting for things that aren’t violations of law but of university policy. The standard of proof is less (preponderance of evidence) and a student gives up certain (NOT Constitutional!!!) rights when the enroll.
For example, A&M prohibits students from making audio or video recordings without all parties consenting. Texas is a one-party State, so a student who recorded a meeting with another student may not be in violation of state law. They may be in violation of a University Rule that could result in them being removed from the University.
It’s the same with sexual harassment/assault. By enrolling at the University, students subject themselves to these expectations. They suck. That’s a federal thing. Change has to happen there first.
Individuals could of course not subject themselves to these tribunals, but then they wouldn’t be students.

Is there something in the student handbook that says if you have consensual sex in your own home with a rando, you have to cuddle and make sure she doesn't feel regret months later?
The problem here isn't the enforcement of university rules; the problem is with university bureaucrats enforcing their own brands of morality to ruin reputations and, in some cases lives.
*And, I'll add, we all know why universities have stepped up the Title IX stuff in recent years. It's not just that they're leftist/feminists, it's that they're scared to death of the fat chick with purple hair running to the media and saying they did nothing. That's not justice.

My original post was in jest. Based on the information, and assuming his lawyer was being truthful, I’m not confident a crime was committed at all. I do not know what the standard for a Title IX investigation and hearing is, but I am sure it is less than the criminal burden under the constitution. So it is very possible what he did merited discipline or expulsion under the university’s discretion within the standards of Title IX, in particular because he is a strident athlete and is held to a higher standard by university code, even if his conduct came nowhere near meeting the beyond reasonable doubt standard for a crime.
So with all of that being said, this really isn’t news other than a strange story. Hopefully it will be off the boards by tomorrow because the only reason I would care is if the univsersirh did something wrong. They didn’t. Game over. And having read through the last several pages of discussion I think this Facebook whining by some small time lawyer has run its course.

Finally got a chance to watch it.
Back in our day, this shite was rampant at A&M. Liberal groups would chase me down at the MSC to try to get me to join their group or sign their petition because of the color of my skin.
And sadly, it wasn't just liberals. Conservative groups were also guilty of this to a lesser extent. If I approached someone with a conservative cause, they would talk to me but with their guard up ready to debate me in a feisty manner.
fricking politics. If you defend Trump, you're a misogynistic, racist troglodyte who is responsible for every gun related death in this country. If you criticize Trump, you're a SJW baby killer whose sole goal is to destroy the moral fabric of this country. You just can't win nowadays.
