University of Alabama: Why are you not asking Miller to confirm whether he read the text?

The text from Miles to Miller 7 minutes before the shooting:
If Miller read this text prior to delivering the gun, then Miller had an objectively clear basis to know the gun could be used in the commission of a crime. A gun is not used in the commission of a crime if it is used for self-defense, but self-defense only applies when using the gun is necessary to protect oneself or others from serious bodily harm. If Miller did read the text prior to delivery, would it be a persuasive defense that he thought Miles was needing the gun out of necessity and had no other option to de-escalate the situation? I don’t think any reasonable person would find that to be a persuasive defense.
So U of A, why are you not asking Miller to confirm whether he read the text? Do you not care? Do you not have standards? Are you afraid to lose a good player off your basketball team?
If you have asked Miller to confirm this, you should let the public know you are in fact doing your job the way it should be done.

He’s already cooperated with police, turned his phone over to have texts read, and his attorney confirmed that already.

There’s no way to know if he read the text prior to arriving. It’s Miller’s word to say whether he did or not.
