I might have sympathy if it wasn't Barstool. I don't hate Barstool, but the followers are creepy little dweebs who treat it like a religion

It's not because it's a tournament for bars, it's because of the name and logo

They could have called it anything else that isn't close to March Madness and came up with their own logo. They did not.

and if barstool didnt literally have a well established history of ripping off content from people and passing it off as their own creative content

No I understand the law, but I disagree with being this petty. NCAA uses players OWN NAMES to make money off of them and wants to protect their own trademarked names. Just making that point baw

I don’t think there’s anything wrong with being ignorant of laws like this. What’s remarkable is people who still argue when informed of the law

Whoever made the logo at barstool should be fired

Then again they probably did this on purpose just so he could say he was being sued by the NCAA

Parody is a legitimate use under the trademark law. That's exactly what this is....

Not always. I would also question whether this even fits as the legal definition of parody since it makes no criticism of the NCAA tournament and its a joke that could have been made without replicating the NCAA logo so closely.

"the purpose of a parody is to comment on or criticize the work that is the subject of the parody. By definition, a parody is a comedic commentary about a work, that requires an imitation of the work."

In the end the NCAA will accept Barstools apologies and settle for some minor meaningless amount or the NCAA may even drop it, but they'll be able to say they made the attempt at defending the trademark as required by law.

that's a cease and desist letter, not a lawsuit

you would think the son of a lawyer would know better

NCAA is so money hungry. They already make millions off of unpaid athletes, but lets still sue Barstool for Barch Madness. What a joke of an organization

You do realize that the NCAA is a non-profit institution, and the money they generate gets put back into the member institutions to support the very players and students everyone always talks about. The only exception is administrative expenses and salaries for NCAA employees. They're not a mafia sitting around a table, dividing up the money and stuffing it in their pockets. They're far from perfect, but so many anti-NCAA arguments are completely over the top.

As for BarStools, they're a joke. They're also a hypocrite. This is the same people that sued the NFL for ripping off a T-shirt with a slogan on it.

Mark Emmert makes around $2 million a year. That's some kind of non-profit......

CEOs/Executive Directors of giant non-profits get paid good money because they are humongous and have to be run by good, smart people who know what they are doing and therefore those people have to be paid the going rate for good, smart people.

You can debate whether Emmert is one of those, but that isn't some sort of absurd salary for the head guy at a massive non-profit.
