Not if he’s a public figure because of his internet celebrity status. Comes with the territory of claiming such status, especially since it’s probably hard to argue that the meme is commercial in nature. Plus, they’re not specifically calling him a child molester or otherwise naming him individually at all technically, just that he looks like he has a baby face yet also a windowless van with “FREE CANDY” sprayed on it

Does it matter if it’s fair use? He’s not suing for copyright infringement. I don’t think fair use applies.

I just assume a right to publicity or something similar will come up since he’s suing them for publishing a picture of himself to which he had no reasonable expectation of privacy (since he’d already published the picture himself) with disparaging remarks added. They didn’t name him specifically as either Steven Ray or Stingray, but did use his likeness. Whether or not they had the right to use his likeness should come up, and they should have fair use of it assuming he’s an internet celebrity. I also wonder if he ever sent out any C&Ds to Worldstar or Barstool before filing suit

Ok yea, I see what you’re saying. It is a fair use issue in a way then. Has anyone successfully sued a news outlet for invasion of privacy in this way? What exactly did Hogan sue Gawker for?

Well, I think problem #1 for him will be that, if he seeks more $75,000 in damages, he has filed in the wrong court.

Portnoy’s father is an attorney. I’m sure Barstool has closed up all loose ends like this before any litigation can be brought to them
