From who? And on what grounds?
Anti-trust? Congress is the controlling authority on trust law since they wrote it in the first place. The commerce clause gives Congress the right to regulate business, and they are the authors of all anti-trust law, so they can tweak it as they see fit.
With all the schools on board, this is happening.

Obviously we haven’t seen the final language of the bill but Congress borrowed a ton of language from a similar horse racing bill from around 2021. Since that passed the 5th circuit has struck it down 3-4 times
Due process, congressional delegation, and one more thing that won’t come to mind right now that would be applicable to this bill as well
Edit: 5th circuit found HISA unconstitutional the most recent time because Congress delegated legislative, adjudicative and enforcement powers to a private entity.
Essentially the same shite they’d do with this bill. Either the ncaa can make rules, can enforce rules, or can adjudicate matters but they can’t do all three

You need to actually read the opinion of the 5th Circuit. They never once said the bill's provisions was unconstitutional. The issue they had was with their belief that Congress cannot give a private entity (the Horseracing Integrity and Safety Authority) the regulatory and enforcement powers of the United States government. However, the Supreme Court has signaled that the Fifth Circuit is wrong in this opinion.

Horse racing is a totally different thing than college sports. Legislated and regulated in a totally different way. There is zero correlation. The HISA created a body that was in essence a government body that could do things like issue subpoenas. The NCAA does not become a body like that due to this legislation. You really need to read the opinion.

The NFL, NBA, MLB, etc. all do this in their respective sports.

Good. CFB has been run amuck by the shady powers that be. NIL has ruined everything in “college” sports. Hopefully they outlaw it all. 18 year olds don’t need to get paid anything to play a sport. Already have free room and board, best training facilities and whatever they need.

I’ve read the opinion several times. I don’t really know where your disconnect is. Do you think Congress is granting the NCAA authority to make rules regarding eligibility, portal etc but not investigate or adjudicate those issues?

According to this Texas A&M would be forced to play Arky, LSU, and Texas every year. Would be nice to retain the annual Arky game. Decades of history their.
