None of their eligibility rules are enforceable. What's stopping an NFL returning next year? What's stopping someone from challenging 5 for 5 next year? It's not hard to find a state judge either.

Why?

Someone was going to get screwed no matter what. Under your idea, the people being screwed just would have shifted from the 2022 athletes to the incoming freshman.

Because the 2022 people would have all been given eligibility after freshman had already signed. So they would then have been told they no longer had a roster spot as a 2022 player is now filing it. Or they chose a school due to available playing time, which would suddenly be gone because a 2022 is now returning.

No matter what someone was going to get screwed.

People can say that all they want, but it's not. What prohibits someone next year from going to a state court and doing the exact same thing? What legal basis does the NCAA have to enforce 5 for 5? Or to say that ok these pro athletes can come back but no more starting next year? They have absolutely no authority to enforce either of those rules.

A 27 year old 5 year NFL vet who can't quite crack a roster is infinitely more valuable on a college field than an 18 year old true freshman.
