Nutt should insist on receiving his settlement check face to face instead of through the attys. Imagine the smile on his face when one of the Black Bears' hands him the check.

You just proved that Nutt was slandered. Because this is not true. 2 level ones happened while Nutt was head coach. 5 happened under Freeze. Nutt is not named but Freeze is named in violation 8.

It is important to understand that the issue is not whether statements by Ole Miss "sources" were truthful, but whether they negatively affected his coaching opportunities. Ole Miss agreed not to make statements that would negatively impact him in seeking coaching positions. Truth or falsity is simply not at issue. (Except to extent punitive damages are at issue)
What is amazing is that no one at Ole Miss apparently was aware of the contract terms or was paying attention to the information being released by Ole Miss sources that could be construed as a violation of the contract, and exposing the university to a lawsuit, which is certainly not on its face frivolous.
Of course by this point, Ole Miss can't apologize without essentially conceding they violated the contract. So they are now pretty much committed to seeing it through to the end.
Ironically, if the federal case is dismissed, in whole or in part, for lack of federal jurisdiction, the case will likely end up in Hinds. That means it will be in a jurisdiction where Ole Miss may not have the most sympathetic jury pool.
I'm not sure Nutt will have an easy time if he gets to trial proving damages, but one never knows with a jury, and I'm not sure Hinds is the venue I would want if I'm Ole Miss. But no matter what the outcome, Ole Miss will come out tarnished. And for simply not being aware of the situation. And it will cost the university, if nothing else, a bucket load of attorney fees.

Nutt isn't qualified to coach a pee-wee football team much less a university and every school knows it. Ole Miss's statements had no effect on his employment so he can kick rocks.
