What you think and what the law says are two different things. The schools could only do it for as long as their states allowed it. Once all the states made it illegal it effectively killed any bylaw the conference could ever make.
MLB was the only one to get an exemption without a CBA. The NFL and all other pro sports gained a limited antitrust exemption by letting the players unionize and negotiating a CBA. CFB will have to do the same. The NCAA and SEC are notorious for using selective enforcement. Just like they’re doing here. Bediako case is a prime example. They actually played him in 5 games
Was Alabama sued? Were they threatened with expulsion? Were they threatened with program crippling penalties? LSU got each and every one of those for just thinking about it. They still haven’t rostered a player yet. That’s why the NCAA falls under the Sherman Act and and courts should decide the rules until all rules are applied equally.

The states wouldn't allow it for the same reason the schools wouldn't do it to start with. It's not 1950 and people don't want that shite.

It can be a rule that says all members must claim the sky is brown. You can argue how much the sky is blue all you want to, but the actual question won't be about the color of the sky, it will be about if the SEC has the right to create its own rules and penalties.
The issue in federal court is going to be whether the SEC can change their rules after the fact in order to selectively target a single program. And the answer is no, they can't.

They weren't. It's like claiming you were treated unfairly because an item you bought went on sale a week later.
If you had told me that TV was going to be $100 cheaper last week, I would have waited! I'm the victim, I was treated unfairly.
