There is a big difference legally between a waiver and a contract.

By law, a NFL waiver and participation agreement is a NFL contract.

As pointed out yesterday in a Louisiana court....the SEC in it's haste to make these new rules didn't specify what type of NFL contract makes them a NFL player.

They get to pick and choose the selective enforcement.

The receipt of per diem is where they cross into contract territory. Agreement on per diem for activities performed is a two way agreement, I.e a contract.

It’s all rolled into one document through the CBA, but it’s still there, and it’s still a contract.

The players are never on an NFL roster. I get that you guys are upset, and i have no dog in this. I have nothing against LSU, and grew up an LSU fan, and my family was good friends with an all time LSU player. (George Rice)

You can believe what you want, but the players that receive an invite to a minicamp without a contract are not playing under contract.

You have:
drafted players
UDFA signed to a contract
UDFA playing under a waiver, but can be signed to a contract during or after the minicamp

You can strain at gnats and try to twist verbiage, but the players are not on an NFL roster and are not under contract by an NFL team. Now. Do I think it's fair or unfortunate how the NCAA's timing changed things for the players? I agree with you there. The NCAA created this mess. They tend to make decisions without much thought of how it will affect things. I also don't blame LSU for trying to take advantage of every rule they can. Every other team in the country would be doing the same thing.

Signing a two way agreement to receive per diem is the definition of a contract.

Take it up with Miriam Webster for that and the SEC for not specifying that it had to be a contract of employment.

They sign participation agreements that are contracts under the NFLPA and the CBA. You do not know what the frick you are talking about.

I am not arguing what you are saying. I am saying I can't find this. Can you provide a link, please?
I don't see anywhere that the judge talked about what is or is not a contract concerning the NFL. The ruling, as i understand it, is not even a finalized ruling per se, but an injunction, until a ruling can be made and finalized.

BATON ROUGE, La. (AP) — LSU coach Lane Kiffin’s chances of fielding former NFL players improved Thursday night when a Louisiana judge issued a preliminary injunction against the NCAA in a high-profile eligibility case.

AGAIN, I am not saying you are wrong, only that I can't find what you are saying in the articles I am looking at.

They did not sign a two way agreement for a per diem. The per diem is is given, to them. They sing a waiver. If you can show me anywhere at all that calls it a contract, then I will apologize and agree with you. Everywhere i look, it is called a waiver. There are clear differences in what a waiver is and what a contract is. Stop look on Tiger Droppings and LSU fans that talked about it with their brother-in-law who thought about becoming a lawyer one time and read through news articles.

If they sign a contract with a team, they would have to be place on the teams roster. The players LSU wants all signed contracts. Hutson, at least (I don't know about any of the other players) never signed a contract, and never showed up on an NFL roster.

To me, LSU fans have a MUCH better argument with the timing of the 5 for 5 ruling. I have a lot of sympathy for the players LSU wants when argued under that lens. The NCAA screwed the pooch on that.

How do you think the per diem is given to them? Because the NFLPA and NFL agreed to it in the CBA, which is a contract. Any player who signs on to receive the per diem is signing a contract.

Jesus bro

That is a contractual agreement.

So, are you saying that if I am not an NFL player under contract I can receive a per diem? The collective bargaining agreement is for NFL players under contract. This isn't rocket science. If you are not on an NFL roster you are not covered by a collective bargaining agreement.

ETA
The NFLPA represents NFL players. They do not represent everybody in the world.

Yes, if they extend you an invite.

The CBA extends all the way down to Rookie Mini Camp.

That means every player who attended one of those camps in an NFL player, or none of them are.

Correct. They represent the people who sign contract with them.

Like the rookie mini camp attendees who receive per diem.

ETA: If you’re wondering why this arbitrary line is so difficult to nail down, then you’ve figured out why the judge ruled in favor of the players yesterday.

It won't be official, but I can see the teams that lose to LSU claim a win in their next year's media guide with an asteric next to it.

I am not an LSU fan and frankly, I don't blame LSU fans for being upset. Let's not all pretend if it were our team we would not feel exactly the same.

This is my thing. If this was happening this unfairly to another institution in the SEC, I would have a real problem with it. It's ridiculous to single one school out for doing the same thing that everyone else is doing. Then, to have Sankey outright lie on the stand is crazy to me.

And yet they never showed up, nor have they ever shown up on an NFL roster. Amazing.

Oh, I know. it's an amazing complex issue and all of us could chase our tails arguing this point. I guess that is part of the fun. I would rather make these type arguments than argue with trolls. I don't feel all that strongly either way, to be honest. When I argue like this, it is more to see if people can show me where I am wrong, so that I can learn. I honestly don't get mad or even upset...just want to get caught up on all the facts quickly.

I see your points, so don't think I am not hearing you or thinking about what you are saying. And...I appreciate your patience!

I am not familiar with all of the players involved. What gets LSU is that it is Lane Kiffin, number one. And then the players LSU are trying to bring in all signed NFL contracts as UDFA.

That said...people should realize that the players signed the UDFA contracts, then the NCAA mad the ruling about the 5 for 5, which MAY have changed what they did had the ruling been done before the draft. That's the real shame.

Neither have Harris and Wright.

You seem level headed, so it’s actually fun discussion.

The real issue is competitive balance and even application of rules. The SEC is trying to “make an example” out of LSU over this issue, but that doesn’t fly today. Courts are too involved for the SEC to pick and choose when they will apply a rule and when they will look the other way.

The fact that they didn’t have a definitive line to cross with regards to these players is exactly why Kiffin went after them, because they can’t actually levy any of the punishments they’ve threatened without levying them upon Texas, Oklahoma, Missouri, South Carolina and Arkansas as well.

You can hate him all you want but there isn’t a coach in the game today better at operating in the grey area than Kiffin. He walked right up to their arbitrary line and dared the SEC to overreach, and they bit. They moved the line to suit their needs and got their dicks knocked in the dirt because of it, in a court of law no less.
