Caps are dangerous.

That’s how you get unions and CBAs.

Caps NIL until the class action lawsuit by greedy athletes' agents.

What has greed got to do with it? An attorney, and most agents are, has a legal and ethical obligation to represent their clients best interests to the best of their ability. There is nothing greedy about what players and their agents are doing - there was certainly greed involved just a few years ago when a multi-billion a year industry relied on free labor for about 90% of its production and it was incredibly unethical to claim a college education was payment enough, first of all when a good many of the people being paid with said education weren't able to earn it or benefit from the experience and the school did not make more than an illusory effort to provide the support they would need to get said education. There ain't a university degree on the planet that costs $3 million which is what an NFL caliber edge rusher can make in 3 years in college....thats what that persons efforts are worth on the open market, not $250k worth of education.

I still think you will see a correction over time with NIL.

EVERYONE is throwing money around like drunken sailors. I think performance and a re leveling of transfers will cool the NIL market.

3rd party being any entity that’s not the university.

Collective bargaining meaning union where if someone wants to play college ball they have to join and abide by whatever rules are agreed upon between union and university.

Its highly unlikely that a CBA would limit NIL paid by third parties. It could limit what the school pays and set limitations on how that money was paid ie if a player transfers they owe what they received what the school paid them back to the school or the receiving school would....but its unlikely a CBA with such language would ever be ratified by players for obvious reasons.

Also in most of the US and especially in the south it is unlikely that right to work laws would be overturned in order to require players at UGA, for example, to belong to a union. Pro athletes now do not have to belong to a union in right to work states and it would be a damned difficult thing to do to convince the courts that it is a bad idea for plumbers in Mississippi but not college football players. I am certain the courts in the south would agree wholeheartedly BUT it won't get through the federal courts...the precedent is well established. It will be funny as hell though watching anti-labor politicians in RTW states twisting and turning trying to somehow thread that needle.

This is an interesting idea that I have brought up many times though....wealthy donors in RTW states will be less likely to be as quick to donate or pay as much in NIL money as their counterparts in non RTW states because of their long standing opposition to paying wages as high as those in non RTW states in their businesses. Once you are accustomed to paying union wages you are accustomed to paying union wages. It is not as foreign a concept. This will eventually lead to programs in non RTW states having a slight competitive advantage over those in RTW states...and it is not just wages, it is labor laws across the board that are favorable to labor in non RTW states. You can't move the University of Michigan to Mississippi to take advantage of looser labor laws....and you ain't going to keep Mississippi players in Mississippi paying Mississippi wages. Its going to be HILARIOUS watching Oregon and Washington State and Michigan cleaning up on southern labor while we try to find a way to keep them idiots at home.....

With whom is the collective bargaining agreement is this environment?

Presumably it would be between the players organization and the university. It is hard to imagine a roll for conferences based on well established labor law. There is certainly not a place for the NCAA or any regulatory body like the NFL UNLESS some sort of quasi anti-trust legislation like that enjoyed by the NFL or an actual anti-trust exemption like MLD has passed and that is highly unlikely in todays political environment. When and if there is a players organization and a CBA programs in RTW states, including the entirety of the south, will be at a competitive disadvantage BECAUSE any union and CBA in such states is going to be wanting severely compared to those in non RTW states - negotiating power will be severely diluted at best without mandatory membership and dues being paid. Those states will try to twist out of that but the courts are clear, RTW statutes apply to all employees, not select employees in select industries.

Don’t see how this holds up in court. At the end of the day.. it is putting limits on what players can make.

I hate NIL and the shitshow that college football has become but I am a realist. Players are basically undefeated when it comes to NIL in court.
