It was the name of a publication; not just a reference to the term in an article.
Not arguing whether or not the courts got it right. I am sure they did. Copyright and trademark laws are pretty black and white. But, A&M was not the first to use it. All I am saying.

So no more tshirts, posters, etc. with 12th Man or Home of the 12th Man. Can't help but think this will cut significantly into their merchandising sales.
They couldn't sell stuff with "12th man" on it according to our licensing agreement with them. That's why they went with "the 12s." They want to sell shite, and they can't sell anything with "12th man" on it.

ehh i doubt it. The 12 is a variation of the 12th man or whatever. People will gravitate towards it since it symbolizes that the fans are a big factor in the game. People will buy the shirts and posters regardless.

The Texas Aggies suited up the original 12th Man, E. King Gill, to play in a game in 1922.
That is why CFB's largest student section stands throughout the game.
It looks like we may be through with Seattle and their crooked owner giving us low dollar to use our trademark.
They just can't stomach admitting that football is a man's game.

They're 0-5 vs ranked opponents at home? Yikes!

Crooks win games to. And their owner is a crook.
Just because they went to back to back Superbowls doesn't mean they aren't so politically correct that they won't admit football is a man's game.
They probably have special LGBT bathrooms at their stadium.

We won our bowl.
But since the Badger's kicked an SEC team in the arse in their bowl, we don't have much we can say back to you.

Aggies telling pros what to do. That's pretty impressive.

Ours are nicer
Spent the bulk of our renovation $$$ on those, tbh.

A&M is certainly within their rights to do this but I am curious as to how they are damaged or made any less whole by a pro team using the 12th man thing. Sounds like greed to me.

Damn shame. More people knew it as the "12th Man" than A&M.

You think it's a shame, too?
Good.
Good.

Trademark law is basically setup that if you own a trademark you have to be actively using it. If you're not using it then you lose the right to that trademark. The same goes that you have to be actively protecting it. If you become aware of incidents that may infringe on your trademark you have a duty to go out and investigate those and make a determination on whether you need to give somebody a call, send a cease and desist letter, or make a determination that it probably didn't infringe within the confines of what the law is and so no action is required.

Yes, but it's perfect for Seattle.

Wow. A team with championship appearances and a recent title gives in to a collection of scrubs.
