Marcello was asked what kind of sanctions could we expect:
quote:

This is just my opinion: unless there is more that we don't know, and the NCAA agrees Chuck Person acted alone and without anyone else in the know, then how could you implement more penalties? We'll see.

The letter Auburn sent to the federal court is obviously written by a lawyer, and is done so with a lot of flair as to distance itself from Person, and to show that the damage he caused is by his doing and no one else, and that the damage done by Person has had lasting effects, including more potential sanctions. In other words, lawyers tend to get dramatic when they have to get a point across.

Does Auburn really believe more sanctions could come? I don't know, but they're on the record now as saying they expect an NOA and the possibility of more sanctions.

DC seems to be our Rayjon Tucker replacement. I feel a bit better about our 3 point shooting this year. We are going to have 7 new players this next season, and basically a brand new and more athletic team.

It's a victim statement. Its drafted to provide the parade of terribles for all the damages sustained. I take solace in the fact that there is no other alleged violations included in the statement other than the Purifoy/Wiley payments. If there were other allegations or payments, those would be included in the statement as well - no attorney would withhold info from the FBI to protect a university from the NCAA.
AU may get a NOA, but I can all but guaranty that nothing will come of it.

Not sure why you take solace with this fact. Of course the statement didn’t include other violations- it was drafted only to address the Person issue, nothing more.

I’ll be the negative Nancy

Not sure why Auburn receives a NOA unless there is more that we don’t currently know. Unless, of course, it’s procedural. But if it’s procedural then I’m not sure why there’s doubt in the first place.

Auburn understands that Person has plead guilty and intends to acknowledge his victimization of Auburn and the two student-athletes entrusted to his care. While that is a significant step, that individual admission does little to repair the harm to Auburn and those students, alumni, and fans who support it. However, the University’s Creed equally speaks to obedience to law and the capacity for sympathy, so Auburn requests that the Court proceed with fairness and compassion in sentencing Person
The last paragraph is a gem. "frick you Chuck, but since its in the Auburn Creed, please show him some leniency"

The bit about the expectation of receiving a NOA is just AU's lawyer upping the drama in the letter. Again, this letter was written to really hammer home that Auburn is the victim. In another sense, it can be seen as another way Auburn is being compliant by saying we know there were rules being broken, and we're prepared to face consequences. Whether real consequences are dished out or not is another action all-together.

I understand the letter.

But I don’t think the lawyer says we expect to receive one if we know we aren’t. That’s not what Auburn wants media coverage on as we’re putting together the 2020 class.

And if we know we’re getting one, then saying as much only amps things up to the highest level

I don't think the AD knows whether we will or will not get a NOA. My take is that by mentioning that one is expected, we're playing it safe with the NCAA while simultaneously making us look like we're suffering from what Person did.

We're also keeping one step ahead the other schools caught up in all this by being forthcoming about our actions. Bama, meanwhile, has kept quiet ever since it was revealed that Sexton was linked to payments.

I don't think any bit of this letter was drafted with 2020 recruiting in mind. I also don't think it will affect anything. Players that we're seriously wanting to sign will get the most up-to-date knowledge from the coaching staff.

I'm really curious as to how the NCAA arrived at the $91,500 amount they attempted to pin to Wiley. They said this money was exchanged between Person and an agent connected to the Wiley's...not Wiley or his parents. Do they have proof of this?

Agent probably said “hey Chuck, here’s $100k. Take $8500 of it and give the rest to Wiley so he’ll hire me”. Chuck then pockets $99,200 and gives Austin $800...or something like that.

NCAA has testimony that the agent paid X amount for Wiley, so that’s the number they started with. During their investigation, they discovered Chuck pocketed nearly all of it, so they lowered the amount

To use your same logic against you - why would AU mention the NOA possibility in the Person case if it wasn’t related to Person case? Clearly AU is saying that they expect the NOA as a result of Persons conduct which only includes the Wiley/Purifoy matters

JGT: At this time, JGT is not changing his opinion that Auburn will not face additional sanctions. Questions IF Auburn will get a letter, but if they do it will cover information already discussed between AU and NCAA.

My thinking from this letter from AU to the feds is this:

1. we will get a letter of NOA from the NCAA
2. It will pertain to the Person violations
3. Auburn did communicate w/ the NCAA regarding the violations involving Person, and that is why we accepted the NCAA findings that Purifoy and Wiley be suspended for a year and some.
4. I am HOPING this NOA will be the NCAAs way of documenting officially the Person violations and repercussions, and no other punishment will be coming.
5. But leave it to the NCAA to want to further lay down the hammer regarding the HC being responsible rule they added to Auburn.

One additional sanction: Chuck Persons will be shown a long long long show cause penalty.
