According to some of the new information released Miller and an unknown person is in Miller's vehicle facing away from anything going on. The Jeep pulls up behind them. The shooting starts and two bullets strike Miller's car.

If Johnson turns out to be the aggressor or even if not shouldn't charges against him be made?

If he turns out to be the aggressor, yes.

Having said that, remember the same evidence that let the DA/LE very quickly say with certainty Brandon Miller was innocent of wrongdoing is driving the charging decisions of the others involved.

Eh. A super drunk guy that you had an argument with 5 minutes ago was approaching your vehicle with a firearm. That’s a layup self defense argument

Unless it becomes very clear that he pulled up to the scene looking to restart the fight, no way he gets charged

Didn’t want to derail the basketball thread so now that this thread is going - here’s a detailed account by Ryan Phillips of Patch.com that describes the sequence of events from Darius’ dad - reportedly of what the videos from that night show.

This is part of what I'm referring to as far as new info.

So even in defending yourself you have a responsibility to not endanger others. At a bare minimum it is reckless endangerment.

Let me put it another way.

Miller is struck by one of the bullets and dies.

Johnson is then certainly civilly liable without a doubt. And since Miller has already been found to not be guilty of a crime, Johnson should/would be criminally charged.

When asked by investigators why they had initially stopped and turned on the Jeep's hazard lights, Johnson said it was because he was from Birmingham and they had been lost.

The defense, however, pointed out that Asia Humphrey — the other woman in the Jeep who testified during the preliminary hearing — was a junior at the University of Alabama at the time of the shooting, along with mentioning the different means of way-finding such as a GPS on one's phone.

Slap a Bama jersey on this guy and nobody believes this shite

No.

In Alabama, if you are found to have used deadly force in self defense you are immune from criminal and civil liability.

Code of Alabama 13A-3-23. See d(1).

Unless the force used is determined to be unlawful.

Really sounds like self defense too me.

(Self defense for Miles/Davis)

When you cut your lights off that means you are ready to SLIDE on somebody.

It should be deemed that way.

He should be charged with something.

Why haven't they recovered the other gun?

Thanks for starting a separate thread instead of asking this in the Bball thread.

Given that the guy was able to fire and hit Davis twice, it is clear that he had a gun at his ready. It also appears that the Johnson guy in the Jeep was acting aggressively. Driving around headlights off is something that folks with any familiarity with the hood and gang related behavior would recognize as a red-flag.
We are fortunate that the dude didn't kill several of our players.

Very true. Capital murder is definitely a reach in this case. This guy got rid of the weapon he was shooting because he knew he had something to hide. Tuscaloosa police and the DA office may have jumped the gun.

New write up released today from patch.com

New Evidence Provides Compelling Account Of Bama Hoops Murder Case

The evidence raises questions about the prosecution's case, while also shedding light on why superstar Brandon Miller has not been charged.

Do not trust any media reports either way. Wait for the actual, real evidence to come out at trial. That goes for reports that appear to favor either side.

No reporter has access to either the prosecution or defense’s full evidence.

That article is on point. It’s a shame the state’s biggest media outlet can’t provide that level of journalism.

There can be little doubt in my mind who the aggressor here was,,the Jeep occupants came back looking for trouble.

Johnson is the father of Jamea Harris’ baby. He skipped the hearing and apparently nobody knows where he is right now.

Amazing how that isn’t brought up. Pretty suspicious and I guess raising that point throws a wrench into the media’s narrative.

Wow...I sure hope all of the video is released. It sounds as though the lead investigator didn't do a thorough job. Doesn't know who was the passenger in Miller's car??
