Correct, or while committing a DWI. Either one would have resulted in the gun charge.

Since neither charge stuck, possessing the gun was 100% legal.

It's illegal to possess a firearm while committing worse than a Class C misdemeanor. The DWI charge was a class A and the weed possession a class B. Both of those charges are why the firearm charge came to be. But if both of those charges are ultimately dropped, then the gun charge would have to be dropped as well as a matter of law.

Incorrect.

It is illegal to possess a firearm while committing any offense OTHER than a Class C misdemeanor.

Class C misdemeanors do not result in UCW charges for possession of firearm at the time of commission.

Aren't there only three classes of misdemeanors in Texas (A, B, and C)?

Edit: Just realized I misstated what I meant to type. I meant to say anything worse than a Class C, not Class C or worse.

Is anyone really surprised that this case is going nowhere? It’s A&M for Gawds sake. Throwing money around can make things go away fast

Not really. He was not under the influence. The weed was not his and he did not know it was in the car. It is legal in Texas to carry a gun most places if you are at least 21 without a permit. He passed two breathalyzers. What is he guilty of?

The real question is why did they give him two breathalyzer tests? Would they have given him two if the first one had shown he was intoxicated?

He's only doing what we've empowered cops to do. You do realize that in most states a cop has the power to declare you intoxicated? No test required.

Change the laws. Firing the cop will do nothing. We gave them this power and we need to take it away.

Fake news. At the time it was reported here I stated to wait at least 24 hours or until facts come out. This is my belief no matter what school they attend. Fake news is rampant everywhere these days.

Some posters did convict him in the board of law but lets not lump everyone into the same bucket.

Social media has not been kind to college kids. Used to be newspapers reported and then the next day and then they had more facts. Even then they would still get things wrong. Nowadays everyone wants to be first to report stuff and its usually innacurate to the facts. Best to always wait at least 24 hours but maybe more depending on gravity of situation.

Glad it was cleared up.
