I think it would fly pretty easily.
1. We have rules
2. LSU and the other 15 members voted for the rules
3. The other 15 voted for punishment if you break the rules
4. LSU decided to comply with said rules

It can't be "tied to playing football".
You wouldn't be admitting that LSU is illegally promising NIL payments?
Are they promising playing payments? Incentive payments? Those aren't allowed.

Worst case, LSU settles with them. Regardless, LSU made the correct calculation (in the end) that these two players were not a hill worth dying on.

The reason this was so successful in the past is because it was levied at the NCAA, which has an effective monopoly on the ability for college players to make substantial money from (in theory) their name, image, and likeness while playing college football.
The SEC does not have that effective monopoly.
