I haven’t thoroughly analyzed this, but if the judge restrains the SEC from enforcing its rules and that injunction holds up on appeal, that might put the SEC in an all or nothing position. No punishment/discipline at all, or the nuclear option of expulsion.
Why? Because the First Amendment to the U.S. constitution guarantees the right of association, and disassociation; I.e., expulsion of someone you don’t want to associate with any longer. That right trumps anything the state court could order. This is just academic at this point, of course. But I’m a nerd like that.
