Finebaum just made it sound like Jimmy Rane was the ringleader of this mess.

Clesi will end up leaving Auburn with a settlement in hand after she signs an NDA. Obviously they are gonna want to get rid of her and if they fire her she will sue for wrongful termination and a hostile work environment. Auburn wont want this seeing a courtroom so would end up settling for more than if they just settled with her now. Bottom line she is gonna get paid to disappear.

Anyone can sue anyone for any reason. This is America.

Would she be successful in the sense of recovering a lot of money? Probably not.

Is a lawyer going to take a case on contingency to go through all of the subpoena process to ascertain the IP info from the message board, the customer account info from the respective internet service providers, file lawsuits in a plethora of jurisdictions, pay for the serving of said lawsuits, take depositions and file discovery motions, and then go to court for the actual trials...

...all for what are probably uncollectible judgments?

Even if a court awards a judgment, the plaintiff still has to collect the judgment, and that can be a time-consuming and frustrating process.

If she can't find a lawyer willing to do all of the above on contingency, she would have to fund it out of pocket.

A lawyer isn't going to take a contingency case unless they have a reasonable belief of an actual collectible judgment.

So, if the source of the rumors can be reasonably shown to be someone with significant assets, it may be worth pursuing, but going after message board poster's Dorito-stained team memorabilia, it isn't likely.

Judge would seal it all. And if it was all bullshite anyway, nothing to hide. Maybe a little dirt gets out, but with a million dollar pay day, who cares.

It's really hard to tie an IP address to a particular person if multiple people have access to a computer or phone.

I've seen cases where evidence from Facebook Messenger was thrown out because there was no actual way to prove messages sent under that person's name we're actually sent by that person.

You can sue anyone for anything. Doesn't mean you'll win, but I'm sure an attorney would happily bill for the hours.

Exposing the sex life of a private person is a tort you can sue for. She could also subpoena Chicken for the IP addresses of every poster.
