Possible Transfer Portal Solution?

I was trying to think of a way to keep players from entering the portal after signing these massive NIL deals and hopping to another pay day.

The NIL cannot be tied to playing for the school so any “force them to pay back the money if they transfer” solution is a non starter.

What about making these NIL deals exclusive 4 year deals with a non compete clause. This would mean they cannot sign any other NIL deals during the term of the 4 year nil contract. This would not be tied to playing for the university in any way. This pretty much ensures they don’t jump ship for another payday, because they would then be in breach of contract and would have to pay back their original NIL deal. I know some states have specific laws about non compete clauses, but this could potentially curb the monster that the transfer portal is becoming.

Im sure smarter people than I, with their multi million dollar collectives, have thought of this. But I thought this could be a possible solution.

I know everyone does NiL a little differently but I hope these kids aren’t getting a base sum from these boosters and then leaving. Smart would be to give portions of money over the years in college and receiving the full amount when leaving for NFL or after 4 yrs

I would hope that is going on. It’s the Wild West out there right now tbh. Unbelievable money being thrown around.

Noncompetes generally don’t hold up in right-to-work states, of which most SEC states are.

Not a lawyer but have been sued on such and successfully won in both Tennessee and Texas.

All of you guys who are coming up with these solutions need to go read the Supreme Court decision. Read what Kavanaugh had to say. Any attempt to limit the money that these young men can make will be shut down in court. The Supreme Court was unanimous about this.

I know that capitalism and America and free enterprise are very upsetting to most of you. This is not North Korea. This is the United States.

Damn, well that was my only solution I could come up with lol. Im unsure how you stop the runaway train at this point.

The freedom to contract is essential to capitalism. If these people want to freely enter into exclusive non compete NIL deals why shouldn’t we let them?

Yep, people still don't grasp how big the NIL decision was. There will be fallout for years to come and there is practically no room for the NCAA to work around it. It will be used to crush other NCAA rules and regulations, it is the gift that will keep on giving and there is no way to really stop it.

Here's what I would do. Every athlete in every sport gets a full ride. Football and basketball scholarship/roster numbers are fine however other sports like baseball that only get 11.7 for examlple immediately go to say 30. Adjust every sport to an appropriate roster number for that sport and every athlete is on full scholarship. On signing day the NLI is for 5 years. They also will be signing an employment contract with the university that will pay them whatever amount was negotiated for NIL. This can be a one year deal or longer. Just like a professional contract if you break it then you better have a good lawyer/agent because there will be penalties in the contract language. If the athlete wants to only do a one year deal so that they have the ability to negotiate a new deal each year then fine. Bet on yourself. No different than being in the pros.

Bottomline is all athletes will become employees of the university they represent and get full rides and will be additionally compensated for whatever they can negotiate for whatever length they can negotiate up to 5 years. Structure it like this and some of this portal chaos will calm down.

There was a post about this. Students can’t be employees of the university without tax implications. Paying students exposes them to loss of millions in taxes and thus more negative impact to students and collegiate sports since most athletic departments operate in the negative as is.

Wait til you see what % of the TV revenue the SEC players union is demanding. They’re not giving up the legal leverage awarded them of renegotiating a new deal every year without substantial guarantees.
