I'm not a legal expert, but from the reading of the statute, it seems that this was definitely sexual assault.
I don't think you'll ever see a prosecution, because the victim would have to come forward.
You'll never see a lawsuit, because the victim would not have the shield of anonymity. Who's going to step forward and publicly admit to being an internet laughing stock?
