you can only claim the 5th in a civil suit if what you're asked could be used against you at a criminal hearing. You can't just plead the 5th if you think it would be damaging to your civil case. And the effect not testifying in a civil case has is that it essentially makes what the other side said non-rebutted fact. If you do not testify to rebut what the opposing side has presented, then the Court will take their testimony evidence as the truth. But the only time you'll see someone invoking their 5th amendment privilege in a civil matter is if there is a pending criminal action or their testimony could result in one

Yes, that's what I've been trying to explain but you did a much better job.

If this report is true, you would think they already have very specific info and if the players they talk to give matching information then they have corroborated the info.
Exactly my thinking. They have information of potential benefits that were offered. They are asking players from other schools what they were offered to see if it matches up. If it does, not good. If it doesn't we are in the clear.

We can't sue the NCAA if they've found something has been going on and the stories players/recruits tell them back up what they have found. This is a Forde article so I take everything with a grain of salt. All of this is coming from us leaving a paper trail. If we covered our tracks properly then we would have nothing to worry about.

Where have we lied to the ncaa?

Freeze and Bjorks Twitter accounts don't count as communication between them and the ncaa...no matter how much you want it to be.

To be fair, nobody knows what Freeze, Bjorks, or anyone else has told the NCAA in interviews. From an OM standpoint, one would hope the twitter episode does not lead to uncovering evidence that whatever they said wasn't truthful because that would really be a kiss of death.

While I am all in this thread for the

Let's tap the brakes a bit, since this is a Pat Forde "article". At some point, years ago, he may have been ok, but he's basically been a troll the last 5-10 years (or longer).

withholding information (not self-reporting everything) is the same as lying in the eyes of the NCAA

you are a scholarship player you have to talk to the NCAA

No you don't. The NCAA isn't the FBI. A simple " speak to my lawyer" is all it takes.

Legally, you can't be forced to, that's true. But, if you refuse, you are still an NCAA player and subject to its rules, including rules requiring cooperation with NCAA investigations. Refusing to speak to them is about the most obvious way to fail to cooperate.

you may not have to tell the truth but you have to speak to them

So lie? They lie, a school gets hammered, and the NCAA looks like the hero for nailing the "cheater.

Sounds very professional.

No, he's talking about if a player isn't granted immunity but has to speak to the NCAA. He might lie and say nothing wrong happened because he's worried that his own eligibility will be affected if he tells the truth. This is why they give him immunity but condition it on his telling the truth. If he says nothing happened, and they later find out he was lying, he has no immunity. Unfortunately, it doesn't work the other way. If he says something did happen and they later find out it didn't, they won't do anything to him, basically like a DA won't prosecute a perjurer who testifies falsely against a defendant.

Where Haven't you lied to the NCAA?

Your program cheated, lied about it, boasted about cheating and getting away with it, lied about it again, got exposed on National television, lied and obfuscated again, lied to recruits, lied to the fans, lied to the NCAA. AND AFTER ALL OF THAT, Ole Miss has fricking nerve to self impose 9 scholarships over 3 years.

Ole Miss is done, it's over.

When we had boosters saying "No" to giving the NCAA information they needed for their investigation, the school stepped in and told them to give the NCAA what they wanted or they would be permanently disassociated from the school.

What information have we withheld and how do you know this?

And of the information that wasn't self-reported, how do you know that our staff was aware of it?

It's best to just stay out of this thread honestly. People have their minds made up already and that's fine. We will find out if they were right or wrong when Judgement Day comes.

so you don't think there is anything to the Tunsil stuff that came out draft night? And this was between a staff member and Tunsil, so I'm pretty sure your staff knew about it. And the new stuff with Tunsil wasn't even in the NOA, so I doubt it was self-reported when it happened and just ignored in the NOA
